PUBLISHED IN THE WICHITA EAGLE ON January 30, 2026 ORDINANCE NO. 52-890 AN ORDINANCE PROVIDING FOR THE ACQUISITION BY EMINENT DOMAIN OF CERTAIN PRIVATE PROPERTY, EASEMENTS AND RIGHT- OF- WAY THEREIN, FOR THE PURPOSE OF ACQUIRING REAL PROPERTY FOR THE IMPROVEMENT OF SOUTH 143an STREET EAST BETWEEN EAST HARRY STREET AND U.S. HIGHWAY 54 IN THE CITY OF WICHITA, SEDGWICK COUNTY, KANSAS; DESIGNATING THE LANDS REQUIRED FOR SUCH PURPOSES AND DIRECTING THE CITY ATTORNEY TO FILE A PETITION IN THE DISTRICT COURT OF SEDGWICK COUNTY, KANSAS, FOR ACQUISITION OF THE LANDS AND EASEMENTS THEREIN TAKEN AND PROVIDING FOR PAYMENT OF THE COST THEREOF. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS: SECTION 1. That it be and is hereby declared to be a public necessity to acquire by eminent domain proceedings for the purpose of public right-of-way for the development of infrastructure associated with the improvement of South 143' d Street East between East Harry Street and U. S. Highway 54 in the City of Wichita, Sedgwick County, Kansas, the lands and easements hereinafter described in Section 2. SECTION 2. That the description of the lands and title therein necessary for the purpose of such action is as follows: Clear and complete title for the uses and purposes herein set forth in and to the following -described tracts, to -wit: Road right of way described as A tract of land described as follows; Beginning 70.0 feet South and 40.0 feet East of the NW corner of the NW 1/4 of Section 36, T27S, R2E of the 6th P. M., Sedgwick County, Kansas, Thence Northeasterly 14. 16 feet to a point 60.0 feet South and 50.0 feet East of said NW corner, Thence East parallel to the North line of said NW 1/4 for a distance of 20.0 feet, Thence Southwesterly 39.07 feet to a point 40.0 feet East and 85. 0 feet South of said NW corner, Thence North parallel with the West line of said NW 1/4 15. 0 feet to the Point of Beginning, written by William K. Clevenger, P. S.- 1437 on January 23, 2025; and Road right-of-way described as The South 218.0 feet of the East 10.0 feet of Lot 1, Block 5, Springdale Lakes 2nd Addition, Sedgwick County, Kansas, written by William K. Clevenger, P. S.- 1437 on January 23, 2025. Permanent easements for drainage, public utilities and related uses in and to the following -described tracts, to -wit: The East 10. 0 feet of the West 50. 0 feet of the South 210. 0 feet of the North 460. 0 feet of the NW 1/4 of Section 36, T27S, R2E of the 6th P. M., Sedgwick County, Kansas, written by William K. Clevenger, P. S.- 1437 on January 23, 2025; and The West 25. 0 feet of the East 80.0 feet of the North 336.0 feet of the South 12. 5 acres of the of the South 25 acres of the East 50 acres of the N 1/2 of the SE 1/4 of Section 26, T27S, R2E of the Oh P. M., Sedgwick County, Kansas, written by William K. Clevenger, P. S. 4437 on October 24, 2024. Temporary construction easements for driveway, drainage and road construction in and to the following -described tracts, to -wit: The East 10.0 feet of the West 50.0 feet of the South 190. 0 feet of the North 250.0 feet of the NW 1/4 of Section 36, T27S, R2E of the 6th P.M., Sedgwick County, Kansas, EXCEPT for road Right of Way, described in Film 793, Page 880, recorded with the Sedgwick County Register of Deeds, written by William K. Clevenger, P. S. 4437 on January 23, 2025; and The West 15. 0 feet of the East 65.0 feet of the South 130.0 feet of the North 12. 5 acres of the South 25 acres of the East 50 acres of the N 1/2 of the SE 1/4 of Section 26, T27S, R2E of the 6th P. M., Sedgwick County, Kansas, written by William K. Clevenger, P. S.- 1437 on January 23, 2025; and That part of Lot 1, Block 8, Spring Hollow Addition to Sedgwick County, Kansas, written by William K. Clevenger, P. S.- 1437 on February 4, 2025, being the South 90.0 feet of the North 175. 0 feet of the East 60. 0 feet of said Lot 1; and That part of Lot 1, Block 8, Spring Hollow Addition to Sedgwick County, Kansas, written by William K. Clevenger, P. S.- 1437 on February 4, 2025, being the North 85. 0 feet of the East 60.0 feet of said Lot 1. Said easements will be for a term of two years or 60 days after project completion, whichever is earlier. Access shall be available to the subject properties throughout the easement term. SECTION 3. That the City Attorney is hereby authorized and directed to commence proceedings in eminent domain in the District Court of Sedgwick County, Kansas, for the appropriation of said lands and determination of the compensation to be awarded for the taking thereof. SECTION 4. That the costs of said acquisition when ascertained shall be paid from General Obligation Bonds to be issued for the costs of such improvements; PROVIDED, however, should the City of Wichita acquire said property (and said City hereby reserves its right to abandon the condemnation as to any of all tracts) that General Funds are available for said purpose as provided by law. SECTION 5. That the costs of said acquisition shall be charged to the City of Wichita. SECTION 6. That this Ordinance shall take effect and be in force from and after its passage and publication once in the official City paper. ADOPTED at Wichita, Kansas, this 27th day of January 2026.
