SEPA ENVIRONMENTAL POLICY ACT NOTICE OF DECISION TO ISSUE A MITIGATED DETERMINATION OF NONSIGNIFICANCE Sequalitchew Creek Restoration Plan City File Number: PLNG2023-008 (SEPA) Related File Numbers: PLNG2023-007 (Site Plan Review) Description of proposal: The proposal is to restore year-round flows in Sequalitchew Creek from Sequalitchew Lake to the mouth as well as restore full fish passage throughout the system to support natural life history stages of native salmonids. This will be done using beaver management techniques across the 167-acre Edmonds Marsh, and a series of fish passage capital projects from the Sequalitchew Creek Trailhead to Steilacoom-DuPont Rd. A portion of Robinson Trail in Edmonds Marsh will be replaced with a new bridge designed for pedestrians and maintenance vehicles. An existing concrete pedestrian trail and culvert beneath Center Drive will be removed and a fish passable pedestrian bridge over Sequalitchew Creek will be installed. Ravine habitat improvements will be provided along Sequalitchew Creek as needed. In-water work will take place within the boundaries of Sequalitchew Creek and Edmonds Marsh. Adaptive management and monitoring will take place following implementation to ensure proper functioning of the improvements. Conclusions of the Responsible Official: The Responsible Official has determined, with the mitigation measures listed in the full MDNS, that the proposal will not have a probable significant adverse impact on the environment, and an Environmental Impact Statement is not required under RCW 43.21c.030(2)(c). The mitigation measures described in the full MDNS are required as conditions of project approval. This decision is made after review of a completed environmental checklist, other information on file with the City, and existing regulations. Public Comment: The public comment period was held from November 6, 2023 to November 20, 2023, during which time five comments were received. Appeal Period: Consistent with DMC 25.175.060(4) and WAC 197-11-680, this Determination may be appealed to the City hearing examiner. Pursuant to DMC 25.175.060(3), only parties of record may file an administrative appeal. Per DMC 23.01.210(b)(1)(C), appeals must be filed within 14 days after the issuance of this MDNS (no later than 5:00 pm on September 10, 2026). Instructions for filing an appeal are found in DMC 25.175.060(4). Appeals shall be in writing, be accompanied by the required appeal fee ($487), and contain the information detailed in DMC 25.175.060(4)(d).
