(Sewer Utility User Charges)
STATE OF WASHINGTON, COUNTY OF PIERCE, TO: All parties named in Exhibit “A” attached hereto, and all other persons or parties unknown claiming right, title,
homestead, estate, lien, or interest in or to the real property described in the Amended Certificate of Delinquency dated November 6, 2025.
This Amended Summons and Notice of Application for Judgment of Foreclosure by Summary Proceedings amends and replaces the Summons and Notice of Application for Judgment of Foreclosure by Summary Proceedings previously filed, adding and deleting parcels and parties. YOU AND EACH OF YOU, and all other persons or parties unknown claiming any right, title, homestead, estate, lien, or interest in or to the real property described in the Amended Certificate of Delinquency dated November 6, 2025, are hereby notified the Plaintiff Pierce County alleges as follows: 1. Plaintiff. Plaintiff Pierce County is a political subdivision of the State of Washington. 2. D efendants. The parcels of real property set forth in the Amended Certificate of Delinquency filed November 14,
2025, with the Pierce County Clerk, Room 110, 930 Tacoma Avenue South, Tacoma, Washington 98402, herein, and incorporated herein by reference, are defendants. Additional Defendants include those set forth in Exhibit “A”, attached hereto, and all persons known or unknown, having or claiming to have any right, title, homestead, estate, lien or interest in real property described in the Amended Certificate of Delinquency dated November 6, 2025, or appurtenant thereto. Foreclosure shall remain subject to easements appurtenant to real property, which were established of record in the auditor’s office prior to the sewer service lien, and the claims of such persons will not be affected by these proceedings.
3. S ewer Service User Charges. Pierce County is the owner and holder of an Amended Certificate of Delinquency on file herein for the lien of delinquent charges for the availability of sewer service authorized by RCW 36.94.150 and Chapter 13.13 Pierce County Code, interest at eight percent (8%) per annum, and penalties of ten percent (10%), together with foreclosure costs, including a reasonable attorney’s fee, charged to the property, together with additional amounts which may become due prior to redemption or sale. The charges became due twenty-five (25) days after billing. PCC 13.13.040. When the County Utilities Director certified the delinquencies to the County Assessor-Treasurer, the lien automatically attached to the property, and became superior to all other right, title, homestead, estate, lien or interest therein, except general taxes and local and special assessments of the County, and appurtenant easements of record prior to the sewer service lien. RCW 36.94.150; RCW 84.64.460; PCC 13.13.045. More than sixty days have elapsed since the liens became delinquent, and summary in rem foreclosure is authorized by RCW 36.94.150 following procedures applicable to foreclosure of real property tax liens under Chapter 84.64 RCW. RCW 36.94.150.
4. U nited States. The interest of the United States shown on the Amended Certificate of Delinquency, if any, is a lien filed or recorded with the Pierce County Auditor on behalf of the officer of the United States and on the date set forth in the Amended Certificate of Delinquency page for the parcel affected. Any lien or interest of the United States is inferior to the lien of Pierce County, and the property will be sold subject only to the right of redemption set forth in 28 U.S.C. § 2410. The United States has sixty (60) days within which to answer following service upon it pursuant to 28 U.S.C. § 2410.
5. D ocuments. The Certificate of Delinquency as amended is on file with the clerk of the above-entitled court and is available for your personal inspection during normal business hours at Room 110, County-City Building, 930 Tacoma Avenue South, Tacoma, Washington. Publication of this Second Amended Notice and Summons will be accompanied by publication of extracts of the Amended Certificate of Delinquency dated November 6, 2025, containing the foregoing information. Copies of the AMENDED SUMMONS AND NOTICE mailed or personally served will have appended and incorporated therein by reference extracts of those portions of the Amended Certificate of Delinquency dated November 6, 2025, in which the particular addressee is named.
6. I mportant: Pierce County is applying to the Superior Court for judgment foreclosing its lien against the lots, parcels, and tracts of real property in this Second Amended Notice and Summons described, together with easements appurtenant thereto of record prior to the year for which the sewer service charges reflected in the Amended Certificate of Delinquency is foreclosed, and authorizing sale free of all right, title, homestead, estate, lien, or interest therein to the fullest extent provided by law, subject only to rights of redemption expressly authorized by law, and the lien of general taxes and local and special assessments of the County, and easements of record prior to the sewer service lien. Unless all amounts due, including allowable costs and a reasonable attorney’s fee, have been paid, you must state your defense in writing, and serve a copy upon the undersigned within 30 days after the date of first publication of this AMENDED SUMMONS AND NOTICE, dated November 6, 2025, exclusive of the date of first publication, which will be February 11, 2026. If you have not paid or served your written defense, a default judgment will be rendered in this action against you, without notice, foreclosing the lien of Pierce County in the amount shown to be due against each lot, parcel, and tract as described in the Amended Certificate of Delinquency dated November 6, 2025, plus allowable costs, and public sale of the property and appurtenances will be authorized. A default judgment is one where the plaintiff is entitled to what it asks for, because you have not responded. If you do not defend your claims in the property, only your claims will be extinguished, and no personal judgment will be entered against you for money due. The Court has determined that this case is not subject to the case schedule rules of PCLR 1-6.
7. H earing. The Court specially set the date for final summary hearing on disputed defenses filed and served regarding any property in this in rem proceeding, to be heard at 11:00 on April 3, 2026, in Department #22, Judge Alicia Marie Burton of the Superior Court, 930 Tacoma Avenue South, Tacoma, Washington.
8. Attorneys. If you wish to seek the advice of an attorney, you should do so promptly, so that a written response, if any, may be served in time.
9. S ale. If judgment is rendered against the property, either by default or after a summary hearing by the court, the property will be sold, unless redeemed by payment of the amount of the judgment together with interest, penalties and additional cost to the date of payment.
THE RIGHT TO REDEEM WILL EXPIRE AT CLOSE OF BUSINESS ON THE DAY BEFORE THE SALE, EXCEPT FOR MINORS, INSANE PERSONS, OR THE UNITED STATES OF AMERICA.
The time, date and place of sale have tentatively been set for April 24, 2026 at 9:00 a.m., 930 Tacoma Avenue South, Tacoma, Washington 98402, outside the 2nd floor lobby, but are subject to change. Formal notice of sale will be posted in three public places in Pierce County for ten successive days prior to sale. 10. Excess Proceeds. Liens or claims in the property extinguished by sale do not attach to any excess proceeds,
if claimants fail to redeem the property to protect their interest. Excess proceeds, after payment of all amounts, interest, penalties, foreclosure costs, and all water and sewer district liens will be distributed to the person who held record title on the date of the original Certificate of Delinquency was filed, provided application is made to the Pierce County Office of Budget and Finance within three years after the date of sale.
11. C laimants entitled to bid. If the property is not redeemed prior to sale, owners or lienholders are entitled to bid at the public auction for the property, but their bid will be deemed a payment of the County’s lien, not a purchase, and no deed will be issued to persons who could have redeemed.

13. Service. All pleadings in this foreclosure proceeding must be served upon the undersigned at their address stated below.
