Notice of Intent to Issue Plan Approval #14-00003L Under 25 Pa. Code Sections 127.44 and 127.521, The Pennsylvania State University (PSU) hereby provides notification of the Pennsylvania Department of Environmental Protection's (Department) intent to issue a plan approval to PSU restrict the existing Animal Diagnostic Lab (ADL) Incinerator from combusting Hospital/Medical/Infectious (HMI) Waste. The plan approval replaces regulatory requirements pertaining to HMI Waste Incineration with those applicable to an animal crematory. The PSU representative to contact regarding the proposed project is Mr. Gary Helsel, Environmental Engineer, 148E Office of Physical Plant Building, University Park, PA 16802. The Department's review of the information submitted by PSU indicates that the proposed change in the method of operation of the ADL Incinerator will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue the proposed plan approval. There are no proposed physical modifications to the equipment associated with this plan approval. The plan approval involves the cessation of HMI Waste Incineration and reassessment of the applicable regulatory requirements, including the PA Crematory Regulation Act of 2024. The proposed change does not include any new materials to be incinerated nor any increase in throughput. The existing wet scrubber will continue to be utilized while the source is operating. No significant emissions increase is anticipated from the proposed change and emissions of several hazardous air pollutants are expected to decrease or be eliminated. The following is a brief description of the new and modified conditions the Department intends to place in the plan approval in order to ensure compliance with all applicable air quality regulatory requirements: (1) Emissions from the ADL Incinerator shall not exceed the following limits: (a) Hydrogen Chloride: 30 ppmdv @ 7% O2; (b) Sulfur Dioxide: 30 ppmdv @ 7% O2. (c) Filterable Particulate Matter (FPM): 0.08 gr/dscf @ 7% O2; (d) NOx: 5 tons/year; (e) Visible Emissions: 10% for more than 3 min/hour or 30% at any time. (2) The ADL Incinerator shall only be fired on natural gas. (3) No HMI Waste shall be incinerated in the ADL Incinerator. (4) The maximum charge rate of waste shall not exceed 500 lbs/hr. (5) A test protocol for FPM shall be submitted within 180 days of issuance of the plan approval and the test performed within 90 days of protocol approval. (6) A trained operator shall perform an observation for visible or malodorous emissions at least once during each cremation cycle. (7) The primary and secondary combustion chamber exit temperatures shall be continuously monitored and recorded. (8) PSU shall create and maintain records of each cremation cycle and other records as detailed in the plan approval. (9) PSU shall notify the Department in the event of a malfunction. (10) In the event of a scrubber malfunction, PSU shall immediately cease the waste feed to the incinerator. (11) PSU shall achieve a minimum incineration temperature of 1600°F as detailed in the plan approval. (12) All new operators of the source shall receive adequate instruction from the manufacturer's representative or another qualified training source. (13) The ADL shall be attended by a trained operator at all times when the source is in operation. (14) If nighttime operation is to occur, adequate lighting must be provided to enable observations for visible emissions. (15) The ADL Incinerator is to be used to incinerate animal remains and may also be used to incinerate expired pharmaceuticals, drugs confiscated by law enforcement, old police uniforms, and evidence from previous court cases on behalf of state and local government agencies. The facility is a major (Title V) facility. If the Department determines that the source is operated in compliance with the plan approval conditions and the specification of the application for Plan Approval 14-00003L, the requirements established in the plan approval will be incorporated into Title V Operating Permit 14-00003 pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450. Any person(s) wishing to protest issuance of the plan approval modification that they believe should be considered in the Department's review of the respective plan approval application may do so by submitting the protest or comments in writing to the Department at the address listed below. Protests or comments must be received by the Department within 30 days from the last date of this publication in order to be considered. Each written protest or comment must contain the name, address and telephone number of the person submitting the comments, identification of the proposed plan approval (specify Plan Approval No. 14-00003L) and a concise statement explaining the relevancy of the protest or comments to issuance of the plan approval. A public hearing may be held, if the Department in its discretion, decides that such a hearing is warranted based on the information received. All persons protesting the issuance of the plan approval modification, submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper of general circulation in the area, or by letter or telephone, if the Department determines such notification is sufficient. A copy of the plan approval modification application and all pertinent document used in the evaluation of the application are available for public review between 8 a.m. and 4 p.m. at the Department's North Central Regional Office.
