DECLARATION OF TAKING CENTRE COUNTY NO. 2026-CV-1678 ORD Sewer Authority ("ORD"), by and through the undersigned counsel, respectfully submits this Declaration of Taking, stating in support thereof as follows: 1. This action seeks public sewer and related construction easements for public purposes pursuant to the Eminent Domain Code, 26 Pa. C.S. §§ 101-1106, and the Municipality Authorities Act, 53 Pa. C.S. §§ 5601-5623. 2. This action seeks easements only; this action does not seek ownership in any impacted properties. 3. The condemnor is ORD Sewer Authority, which is a Pennsylvania municipality authority that has offices located at 235 Skips Lane, Osceola Mills, Pennsylvania, 16666. 4. The properties subject to this Declaration of Taking are listed below. 5. All of the properties referenced above are located in Centre County, Pennsylvania, at the locations and tax parcel numbers set forth below. 6. Where an address of the property is unknown or does not exist, the property's street is listed. 7. Plans for the overall project are attached to the Declaration of Taking as filed with the Court. 8. Plans for the specific properties being condemned are attached to the Declaration of Taking as filed with the Court. 9. The foregoing plans will be filed with the Recorder of Deeds of Centre County concurrently with this Declaration of Taking. 10. The foregoing plans are also available for inspection at the offices of ORD or at the offices of the undersigned counsel. 11. This Declaration of Taking is filed pursuant to a resolution adopted by ORD on June 17, 2026. 12. The foregoing resolution will be recorded in ORD's official minute book and can be examined at ORD's office or at the offices of the undersigned counsel. 13. The purpose of this condemnation proceeding is to obtain easements and/or rights-of-way for the purposes of extending ORD's wastewater collection system and for all other reasonable and valid purposes allowed by law. 14. ORD files with this Declaration of Taking an open-end bond without surety pursuant to 26 Pa. C.S. § 303(a), so that just compensation for this taking is made or secured. A copy of the bond is attached to the Declaration of Taking as filed with the Court.
