PUBLIC NOTICE
Pursuant to the Clean Streams Law notice hereby is given that Warner Company, with an office located at 600 New Ludlow Rd, South Hadley, MA 01075, has made application to the Pennsylvania Department of Environmental Protection for renewing its existing surface mining permit and related NPDES permit. The current permits, SMP # 4777SM7 and NPDES Permit # PA 0257648, were issued on November 18, 2021, and will expire on November 17, 2026. This application does not contain revisions to the existing operation. The receiving stream for the permit area is an unnamed tributary to Beech Creek. The operations are located in Snow Shoe Township, Centre County and is known as or Halfway Coal Yard (a.k.a. States 1 Mine) and the discharge of a former strip mine identified as "46D". The Halfway Coal Yard permit area, which encompasses 155 acres, is located 0.8 miles east of the village of Kato and north of the intersection of Hall Road and Kato-Orviston Road in Sproul State Forest, as shown on the Snow Shoe SE (PA) Quadrangle, U.S. Geological Survey 7.5-minute topographic map. The 46D permit area, which encompasses approximately 10 acres, is located 0.5 miles west of the village of Kato along Kato Road in Sproul State Forest, as shown on the Snow Shoe SE (PA) Quadrangle, U.S. Geological Survey 7.5-minute topographic map. A related component to this NPDES Modification, governed by a Consent Order and Agreement (CO&A) established in parallel to the NPDES Permit, consists of the installation of a lime doser on the North Fork Beech Creek; this is not presently associated with the existing NPDES or SMP permits. The lime doser area governed by the CO&A, which encompasses less than 1 acre, is located approximately 1.0 mile west of the village of Clarence along Pancake Road, as shown on the Snow Shoe SE (PA) Quadrangle, U.S. Geological Survey 7.5-minute topographic map. A copy of the application is available for public inspection at the Department of Environmental Protection, Moshannon District Mining Office at 186 Enterprise Drive, Philipsburg, PA 16866 and at the Centre County Conservation District Office at 414 Holmes Street, Bellefonte, PA 16823. Written comments, objections, or a request for public hearing or informal conference may be submitted to the Department of Environmental Protection, Moshannon District Mining Office at 186 Enterprise Drive, Philipsburg, PA 16866 within 30 days of final publication in the Centre Daily Times and must include the person's name, address, telephone number, and a brief statement as to the nature of the objection(s).
