TOWN OF LOOMIS NOTICE OF PUBLIC HEARING BEFORE THE TOWN COUNCIL PROJECT: Accessory Dwelling Unit Ordinance Amendment APPLICANT: Town of Loomis REQUEST: Introduce, Conduct the First (September 9, 2026) and Second (October 13, 2026) Readings, and Adopt the ADU Ordinance Amendments Recommended by the Planning Commission PROJECT LOCATION: Entire Town DATE AND TIME: Tuesday, September 8, 2026 and October 13, 2026 at 6:00 P.M., or as soon thereafter as the matter can be heard PLACE: Loomis Train Depot, 5775 Horseshoe Bar Road, Loomis, CA 95650 BRIEF DESCRIPTION OF THE PROJECT: The text of Municipal Code Section 13.42.270 regarding Accessory Dwelling Units (ADUs) was first adopted in 2003 and updated in 2007 and 2024. Since adoption of the 2024 amended text, California state ADU law was further revised. On June 9, 2026, the Town Council adopted Urgency Ordinance 307 to maintain consistency and compliance with state law. It is best practice to follow the adoption of an urgency ordinance with a readoption of the same amendments by non-urgency ordinance; therefore, the Town of Loomis Planning Commission reviewed the amended language of the ADU Ordinance and recommended the amendments to the Town Council through Resolution #26-03 at their regular meeting on August 25, 2026. The amendments add definitions; detail ADU/JADU processing and fees; define two classes of ADUs; reference height standards, rental terms, conveyance, septic systems, owner occupancy, fire sprinklers, JADU deed restrictions, and development timing; address Class 2 ADU size limits, setbacks, lot coverage, open space, parking design, landscaping, and stories; and add processes for permitting previously unpermitted or nonconforming ADUs. Under California Public Resources Code Section 21080.17, the California Environmental Quality Act (CEQA) does not apply to the adoption of an ordinance by a city or county implementing the provisions of Chapter 13 Division 1 of Title 7 of the California Government Code, which is California's ADU law. Therefore, the adoption of the proposed urgency Ordinance was statutorily exempt from CEQA in that it implements state ADU law. If anyone wishes to challenge this project in court, they may be limited to raising only those issues they or others raised prior to the hearing described in this notice or in written correspondence delivered to the Town on or prior to the hearing date. All interested persons should either attend the hearing or submit written comments at or prior to the hearing.
