BRIEF DESCRIPTION OF THE PROJECT:
On June 9, 2026, the Town Council unanimously adopted urgency Ordinance 307 amending Section 13.42.270 Accesory Dwelling Units of the Loomis Municipal Code to better align the Loomis Municipal Code with changes in state law that have been implemented in the past several years with respect to local authority to regulate Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs). While modifications to the Zoning Ordinances are typically provided to the Planning Commission for recommendation in advance of Town Council action, the ordinance was provided directly to the Town Council for adoption and immediate implementation in order to maintain compliance with current state law. Typically, an ordinance affecting planning and zoning is approved by the Council after a Planning Commission recommendation, a first reading and introduction before the Council and then a second reading at a regular Council meeting — with the ordinance taking effect 30 days following adoption. An urgency ordinance needs to be followed at the earliest possible time by a non-urgency ordinance subject to all normal procedures; therefore, the Planning Commission will be considering the ADU Ordinance text in Section 13.42.270 of the Municipal Code for recommendation to the Town Council on August 25, 2026. The ADU Ordinance updates Loomis Municipal Code Section 13.42.270 by adding definitions, processing details, including for previously unpermitted ADUs, revisions to height and size standards, and establishes two classes of ADUs, among other updates to reflect current state law. Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the adoption of this Ordinance (Project) is exempt from CEQA review pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because it will not result in a direct or reasonably foreseeable indirect physical change in the environment. Additionally, the Project is exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines as it can be seen with certainty that there is no possibility the ordinance will have a significant effect on the environment. The ordinance allows certain signage, providing standards to regulate such signage, and does not authorize any new development or cause changes in density or intensity of land use.
If anyone wishes to challenge this project in court, they may be limited to raising only those issues they or others raised prior to the hearing described in this notice or in written correspondence delivered to the Town on or prior to the hearing date. All interested persons should either attend the hearing or submit written comments at, or prior, to the hearing.
