NOTICE OF PUBLIC HEARING
RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTHGATE RECREATION AND PARK DISTRICT APPROVING THE PRELIMINARY ENGINEER'S REPORT FOR FISCAL YEAR 2026-27 FOR THE LARCHMONT COUNTRYSIDE, VINTAGE PARK, SUNRISE FLORIN, SUNRISE GREENS, CHURCHILL DOWNS, COUNTRY CREEK, AND SOUTHGATE LANDSCAPING AND LIGHTING ASSESSMENT DISTRICTS AND ESTABLISHING A DATE FOR THE PUBLIC HEARING PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972
WHEREAS, The Board of Directors of the Southgate Recreation and Park District acting as the legislative body of the Landscaping and Lighting Districts listed below, has previously ordered the formation of the assessment districts pursuant to the provisions of the Landscaping and Lighting Act of 1972, for the purpose of financing certain park and recreational improvements and refurbishments as specified in the District's updated Master Plan and for the purpose of funding maintenance operations of the District; and
WHEREAS, the Board of Directors of the Southgate Recreation and Park District has previously ordered through Resolution the development of an Engineer's Report for the purpose of setting forth plans and specifications for the proposed improvements to be financed through the assessment districts, an estimate of the cost of such improvements, a diagram for the proposed assessment districts, and a description of the amount to be assessed upon assessable lands within the assessment districts; and
WHEREAS, an Engineer's Report as authorized by the Board of Directors has been presented to the Board of Directors for its consideration and approval, which Engineer's Report describes the general nature, location, and extent of the proposed improvements and refurbishments, provides an estimate of the costs of the proposed improvements, sets forth a diagram for the assessment districts, and specifies the amounts to be assessed upon various types of assessable lands within the assessment districts; and
WHEREAS, the Board has reviewed staff recommendations which specifically describe those economic factors affecting the districts which result in insufficient revenue sources to fund either the construction of new recreational and park facilities within the districts as provided in its Master Plan, or to fund the refurbishment and continuing maintenance of existing facilities to meet the expectations of district residents and the requirements of new state and federal regulatory mandates. Staff recommends that the Engineer's Report be approved and that the Board of Directors adopt a resolution of intention that will declare this Board's intention to levy and collect assessments pursuant to the Landscaping and Lighting Act of 1972;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors hereby resolves as
follows:
The Engineer's Report dated May 7, 2026 is hereby approved and filed with the Clerk of this Board as approved pursuant to the requirements of Streets and Highways Code section 22623.
The assessment districts consist of the lots and parcels shown on the boundary maps of the assessment districts on file with the Clerk of the Board of the Southgate Recreation and Park District, and reference is hereby made to such maps for further paticulars.
Reference is hereby made to the Report for a full and detailed description of the improvements, the estimated cost of the improvements and the proposed assessments upon assessable lots and parcels of land within the assessment districts.
The proposed Fiscal Year 2026-27 assessment rates will remain the same as the proposed assessment rates established at the time of forming assessment districts and that were levied in Fiscal Year 2025-26.
The Board hereby orders that a public hearing shall be held before this Board on June 4, 2026, at the Fletcher Farm Community Center, 7245 Fletcher Farm Drive, Sacramento, California 95829, at the hour of 6:30 p.m. for the purpose of allowing public testimony regarding the proposed assessments and for the District's final action upon the Engineer's Report and assessments therein.
Prior to the conclusion of the hearing, any interested person may file a written protest with the Board Clerk, or, having previously filed a protest, may file a written withdrawal of that protest. A written protest shall state all grounds of objection. A protest by a property owner shall contain a description sufficient to identify the property owned by such owner.
The Board Clerk shall cause a notice of the hearing to be given by publishing a copy of this Resolution once, at least ten (10) days prior to the date of the hearing above specified, in a newspaper circulated in south Sacramento County.
