LOS RIOS COMMUNITY COLLEGE DISTRICT RESOLUTION No. 2026-04 Declaring Intention to a Form School Facilities Improvement District
WHEREAS, the California Education Code commencing at Section 15300 and following (the "SFID Law") provides a method for the formation of school facilities improvement districts consisting of a portion of the territory within a school district or a community college district formed for the purpose of conducting a bond election within said school facilities improvement district; and WHEREAS, upon the formation of a school facilities improvement district and following the conduct of a successful general obligation bond election within said territory, general obligation bonds may be issued, the proceeds of which will be applied to finance voter-approved facilities projects within said school facilities improvement district; and WHEREAS, the Los Rios Community College District (the "District"), with territory located across five counties, including primarily in the County of Sacramento, but including territory located in the counties of El Dorado, Yolo, Solano and Placer, has undertaken facilities needs assessments and studies which have identified important facilities improvement needs which need to be addressed, including specifically with respect to its facilities located in the counties of Sacramento and Yolo; and WHEREAS, a local funding source such as the proceeds of a general obligation bond measure is necessary to address said educational facilities needs, with the desired outcome of taxpayer funds staying local, with no voter-approved funds going to state or federal entities; and WHEREAS, with California's high unemployment rates the District and its American River, Cosumnes River, Folsom Lake and Sacramento City colleges, seeks to upgrade facilities and programs for technology, software development and engineering, nursing and other medical professionals, firefighters, law enforcement, and other first responders; and WHEREAS, the District's colleges also must address core upgrades such as removing asbestos and lead pipe, providing safe, clean drinking water and repairing leaky roofs; and WHEREAS, to that end, in the judgment of the Board of Trustees (the "Board") of the District, it is advisable and necessary at this time to commence the process of forming a sub-area within the District consisting of the territory of the District located in the counties of Sacramento and Yolo, to be known as a school facilities improvement district, all pursuant to the proceedings available in the SFID Law, and following said formation, to call and conduct a general obligation bond election therein all for the purpose of obtaining a local financing source for facilities improvements within the territory located in the counties of Sacramento and Yolo counties and which will benefit the properties in said areas; and WHEREAS, on September 10, 2004, the Yolo County Board of Supervisors adopted Resolution No. 04-148 making the SFID Law applicable in Yolo County; WHEREAS, on December 16, 2025, the Sacramento County Board of Supervisors adopted Resolution No. 2025-0804 making the SFID Law applicable in Sacramento County; WHEREAS, as part of the legal process required to form a school facilities improvement district, the SFID Law requires the Board to adopt a resolution declaring certain matters, including (i) its intent to form a school facilities improvement district, (ii) the purpose for which the district is to be formed, (iii) the estimated cost of the project(s) for which the improvement district is being formed and (iv) establishing the time and place for a public hearing by the Board on the proposed school facilities improvement district: Now, therefore, BE IT RESOLVED as follows: Section 1. Recitals. The foregoing recitals are true and correct. Section 2. Intent to Form a School Facilities Improvement District. The Board hereby declares it is necessary and in the best interests of the District for form a school facilities improvement district in the District territory located in the Sacramento County and Yolo County. The Board declares its intent to form a school facilities improvement district to be identified as "School Facilities Improvement District No. 1 of the Los Rios Community College District" (the "Improvement District") within the boundaries of the District. Section 3. Purposes of Formation of the Improvement District. The Board is forming the Improvement District for the purpose of financing school facilities improvement projects within the boundaries of the Improvement District, including the construction, reconstruction, rehabilitation, and replacement of school facilities, the furnishing and equipping of school facilities, and/or the acquisition or lease of real property for school facilities, which are the types of projects that can be presented more particularly to voters in a general obligation bond measure or measures presented to voters of the Improvement District in accordance with the provisions of law implemented with Proposition 39, and all of which will benefit the land within the Improvement District (collectively referred to herein as the "Improvement Projects"). The Board may more particularly define the Improvement Projects to be addressed with the proceeds of a bond measure in the text of a general obligation bond measure or measures, called in accordance with the SFID Law. Section 4. Estimated Cost of the Improvement Projects. The District has conducted a recent facilities assessment that has identified approximately $3.1 billion in facilities needs and Improvement Projects in the Improvement District. Notwithstanding this foregoing cost estimate, general obligation bonds, if approved, will only be issued in a principal amount which does not exceed the amount presented to and approved by voters of the Improvement District, which may occur at one or more bond elections to be held and conducted in the future in accordance with all legal requirements. Section 5. Levy of Taxes Only Within Improvement District. If the issuance of general obligation bonds is approved in accordance with California law by the voters of the Improvement District, all taxes levied for the purpose of paying principal of and interest on any such general obligation bonds shall be levied exclusively upon the lands in the Improvement District, and not on any other land in the District that is not within the boundaries of the Improvement District. Section 6. Boundary Map. In accordance with Education Code Section 15320(e), a map showing the exterior boundaries of the proposed Improvement District meeting the requirements of Education Code Section 15301 is on file with the Board and is hereby approved and available for public inspection at the Office of the Chancellor during regular business hours. Education Code Section 15301(b) does not apply because the District has not formed a community facilities district as provided therein. Section 7. Public Hearing. The Board will conduct a public hearing on the proposed formation of the Improvement District at which any interested persons, including all persons owning land in the District or in the Improvement District, may appear and be heard. The date and time of the public hearing is as follows: Date: Wednesday, April 8, 2026 Time: 5:30 PM (Approximately) Location: District Board Room at 1919 Spanos Court, Sacramento, CA Section 8. Notice of Public Hearing: Publication. Pursuant to the Law, the District shall cause this Resolution to be published in a newspaper of general circulation in each affected county, being Sacramento County and Yolo County, in advance of the public hearing. Said publication shall occur once a week for two successive weeks, in accordance with Government Code Section 6066, beginning no later than 14 days prior to the date set for the public hearing. Section 9. Additional Findings. The District has not previously created community facilities districts pursuant to Government Code Section 53311 and following which have boundaries that overlap with the proposed Improvement District and as such, Education Code 15301 (a) and (b) do not apply. The Board determines that it is necessary and in the best interest of the District to form a school facilities improvement district pursuant to the SFID law to finance facilities and purposes authorized by Education Code Section 15100. Further the Board finds that issuing general obligation bonds relating to the Improvement District is the most attainable and beneficial option for obtaining financing for the Improvement Projects, and as such, as required by Education Code section 15301(c), it finds that the overall cost of issuing general obligation bonds would be less than the overall cost of other school facilities financing options available to the District, if any, including, but not limited to, forming a community facilities district and issuing bonds pursuant to the Mello-Roos Act. Section 10. Effective Date. This Resolution shall take effect immediately upon adoption hereof.
