AMENDED NOTICE OF SALE
BY VIRTUE OF A DECREE of the Court of Common Pleas for York County in the case of Newtek Small Business Finance, LLC, Plaintiff, vs. Troy B. Kelley; De Lage Landen Financial Services, Inc.; Founders Federal Credit Union, under Case No. 2025-CP-46-01938, I, the undersigned, Master in Equity for York County, will offer for sale at public outcry at 11:00 A.M., on Monday, September 14, 2026, at York County Family Court, Courtroom 4, at 1555 West Main Street, Rock Hill, SC 39732, the following described real property, to-wit:
All that certain piece, parcel or lot of land lying, being and situate in the County of York, State of South Carolina, and being shown on a Plat of Property of Troy B. Kelley and Mary Anne Kelley, dated March 30, 1994, recorded in Plat Book 121 at Pages 475, Office of the Clerk of Court for York County, South Carolina, said plat being incorporated herein be reference for a more complete description of metes, bounds, courses and distances as according to said plat may more fully appear. DERIVATION: This being the identical property conveyed to Troy B. Kelley and MaryAnna Kelly by deed from James F. Fouche and Kathleen F. Fouche, dated March,1994, recorded April 12, 1994, in Book 979 at Page 37, in the Office of the Clerk of Court for York County South Carolina Also, see deed recorded November 21, 2013, in Book 13837 at Page 170. TMS# 544-03-01-015; Property Address: 4449 Beech Haven Drive, York County, South Carolina.
TERMS OF SALE: For Cash: the purchaser shall be required to deposit the sum of five (5%) percent of the amount of bid (in cash or equivalent) as earnest money and as evidence of good faith. If the Plaintiff is the successful bidder at the sale, the Plaintiff may, after paying the costs of the sale, apply the debt due upon its Mortgage against its bid in lieu of cash. Should the person making the highest bid at the sale fail to comply with the terms of his bid by depositing the said five (5%) percent in cash, then the property shall be sold at the risk of such bidder on the same sales date or some subsequent date as the Master in Equity may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of his bid within thirty (30) days of the final acceptance of his bid, then the Master in Equity or his designated representative shall re-advertise and resell the property on the same terms on a subsequent date at the risk of such bidder. The purchaser to pay for documentary stamps on deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the interest rates contained in the Order.
Note: As a Deficiency Judgment was granted, the bidding shall remain open for a period of thirty (30) days after the date of the sale as provided by law in such cases and compliance with the bid shall be made within twenty (20) days after the second sale. Plaintiff reserves the right to waive deficiency prior to the sale.
Note: The Mortgaged Property will be sold subject to that certain mortgage held by Founders Federal Credit Union as successor by merger with Arrowpointe Federal Credit Union.
Note: If the Plaintiff or the Plaintiff's representative does not appear at the scheduled sale of the above-referenced property, then the sale of the property will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day.
Note: This sale is also made subject to all York County taxes and existing easements and restrictions of record.
