NOTICE OF SALE 2026-CP-46-00267 BY VIRTUE of a decree heretofore granted in the case of: Vanderbilt Mortgage and Finance, Inc. against Francisco Pedraza, Jr.; The Personal Representative, if any, whose name is unknown, of the Estate of Sherry Ann Harris Moten; her Unknown Heirs, and any other Heirs-at-Law or Devisees of Sherry Ann Harris Moten, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, I, the undersigned Master in Equity for York County, will sell on August 3, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land together with any and all improvements thereon, situate, lying and being located in Bethesda Township, York County, South Carolina, containing 1.008 acres, more or less, and being more particularly shown and delineated on a plat entitled, "Property Survey for Darby Rentals and/or Darby Capital" prepared by Hucks and Associates, PC, dated October 7, 2021 and recorded October 19, 2021 in the Office of the Clerk of Court for York County in Plat Book 167 at Page 453; said lot having such metes and bounds as reference to said plat will show; all measurements being a little more or less. SUBJECT TO a non-exclusive easement and right-of-way running over, across and through the subject property as shown on the above-referenced plat. Also includes a mobile/manufactured home, a 2022 CLAT VIN: OHC031905NCAB This being the same property conveyed to Francisco Pedraza, Jr. and Sherry Ann Harris Moten by deed of Darby Rental, LLC dated August 8, 2022 and recorded on August 12, 2022 in Deed Book 20346 at Page 47; thereafter, upon information and belief, Sherry Ann Harris Moten passed on April 22, 2024 leaving her interest in the property to her unknown heirs. TMS No. 408-00-00-111 and 408-00-00-111.002 (MH) Property Address: 4808 McConnells Highway, York, SC 29745 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 9.3000%.
