NOTICE OF INTENTION TO CLOSE AND ABANDON A PORTION OF COLTHARP ROAD
STATE OF SOUTH CAROLINA; COUNTY OF YORK IN THE COURT OF COMMON PLEAS; IN THE SIXTEENTH JUDICIAL CIRCUIT; EX PARTE: ABI Coltharp Road Land I, LLC and Vista Road Rentals, LLC, Petitioners, IN RE: Proceeding under Title 57, Chapter 9 Code of Laws of South Carolina, 1976, as amended, abandonment or closing of streets, roads, or highways. NOTICE IS HEREBY GIVEN pursuant to S.C. Code Ann. § 57-9-10, et seq., Code of Laws of South Carolina, 1976, as amended, that Petitioner will, upon the completion of publication of this Notice in accordance with Section 57-9-10, file a Petition to Close or Abandon Street, Road or Highway with the Court of Common Pleas for York County, South Carolina, to close and abandon a portion of the road or street known as "Coltharp Road," located in the City of Fort Mill, York County, South Carolina, which is described on the attached Exhibit A and incorporated herein by reference. Petitioner believes the requited publication period with expire on or about June 23, 2026. Petitioner seeks to close and abandon a portion of Coltharp Road identified on Exhibit A on the grounds that it would be in the best interest of all concerned to close a portion of Coltharp Road and that, after the closing of this portion of Coltharp Road, owners of property along Coltharp Road will not be inconvenienced in their access to US Highway 21 or Pleasant Road, via the remaining portions of Coltharp Road. The owners which abut Coltharp Road and appear to access other portions of Coltharp Road which are not subject to this action are David Coltharp aka David Allen Coltharp; Habersham HOA, Inc.; Jeremy A. Hunter; and Jones Family MPS, LLC (collectively "Access Owners"). The owners which may rely on access over other parcels in order to access unaffected portions of Coltharp Road, should not be affected, but are named herein out of an abundance of caution, are Carl I. Latham, III; John O'Neal Latham; Thomas A. Latham; Mary Helen Latham; and David Coltharp (collectively "Non-Access Owners") (hereinafter Non-Access Owners and Access Owners are collectively referred to as "Respondents"). This action will not alter or amend the access or easements utilized by Access Owners to reach Coltharp Road and access ingress or egress via intersecting US Highway 21 or Pleasant Road. Therefore, Petitioner will seek an Order of this Court (i) closing a portion of Coltharp Road identified on the attached Exhibit A and (ii) granting title to Coltharp Road to the Petitioner.
