2025-CP-46-04223 BY VIRTUE of a decree heretofore granted in the case of: Athene Annuity and Life Company against Courtney Leigh Smith, Individually and as Trustee of the Leigh Richards Revocable Trust Under Trust Instrument Dated 09/01/2020, I, the undersigned Master in Equity for York County, will sell on July 6, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: BEING all that certain piece, parcel or tract of land lying, being and situated in YORK County, South Carolina, and being shown and designated as Lot 19, fronting on Joe Louis Street (Formerly African Street), containing .247 acre, as shown in Plat Book E 250 Page 9; in the Office of the Clerk of Court, YORK, County, South Carolina and having such metes and bounds, coursed and distance as reference to said plat will more fully appear; reference to which plat is hereby made for a more particular description. This being the same property conveyed to Leigh Richards and Courtney Leigh Smith as Co-Trustees of the Leigh Richards Revocable Trust, Dated 9-02-2020, by deed from Jonathan Pacilio dated April 22, 2021 and recorded June 23, 2021 in Book 19371 at Page 478, in the Office of the Register of Deeds for York County, South Carolina. Thereafter, this being the same property conveyed to Leigh Richards and Courtney Leigh Smith as Co-Trustees of the Leigh Richards Revocable Trust, Dated 9-01-2020, from Leigh Richards and Courtney Leigh Smith as Co-Trustees of the Leigh Richards Revocable Trust, Dated 9-02-2020, by deed dated September 22, 2022 and recorded December 7, 2022 in Book 20533 at Page 423. Thereafter, Leigh Richards died on or about February 17, 2023. TMS No. 020-04-33-007 Property Address: 307 Joe Louis Street, Fort Mill, SC 29715 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 8.4990%.
