THIS BEING THE SAME PROPERTY CONVEYED TO TARKKA YVETTE BERRY AND NAOMI RENEE CLARK-BERRY AND RAVEN YVETTE BERRY, AS JOINT TENANTS WITH RIGHTS OF SURVIVORSHIP, BY DEED OF CARL BERRY AND SUSAN BERRY, DATED FEBRUARY 2, 2024, AND RECORDED ON FEBRUARY 8, 2024, IN BOOK RB 21153 AT PAGE 451, IN THE OFFICE OF THE REGISTER OF DEEDS FOR YORK COUNTY, SOUTH CAROLINA. TMS No.: 010-05-07-085 Property Address: 949 CAPETOWN LANE, CLOVER, SC 29710 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and first applied to the cost incurred by the Plaintiff related to the sale and the balance then applied to the Plaintiff's debt in the manner suitable to the Plaintiff. Should the last and highest bidder fail to comply with the other terms of the bid within thirty (30) days, then the Master In Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day. Plaintiff is demanding a deficiency. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Deficiency judgment being demanded, the bidding will not be closed on the day of sale but will remain open for a period of thirty (30) days as provided by law. Purchaser to pay for documentary stamps on the deed. The successful bidder will be required to pay interest on the amount of the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 7.0% per annum. The sale shall be subject to any past due or accruing property taxes, assessments, existing easements and restrictions of record and any other senior encumbrances. The sale shall be subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given. Neither the Plaintiff no its counsel make representations as to the integrity of the title or the fair market value of the property offered for sale. Prior to bidding, you may wish to review the current state law or seek the advice of any attorney licensed in South Carolina. In the event an agent of the Plaintiff does not appear at the time of sale.
