Notice of Sale C/A No: 2024-CP-46-03338 BY VIRTUE OF A DECREE of the Court of Common Pleas for York County, South Carolina, heretofore issued in the case of Freedom Mortgage Corporation vs. Melodee L Wolbert I the undersigned as Master-in-Equity for York County, will sell on June 1, 2026 at 11:00 AM at Moss Justice Center 1675 York Hwy, York, South Carolina 29745 to the highest bidder: Legal Description and Property Address: ALL THAT CERTAIN PIECE, PARCEL OR LOT OF LAND, WITH THE IMPROVEMENTS THEREON, LYING, BEING AND SITUATED JUST OUTSIDE THE INCORPORATE LIMITS OF THE TOWN OF YORK, YORK COUNTY, SOUTH CAROLINA, AND BEING SHOWN AS LOT NO. C-13, ON PLAT OF WOODLANDS REALTY AND DEVELOPMENT COMPANY PROPERTY MADE BY LOUIS ROTH, ENGINEER, DATED JULY, 1946, WHICH PLAT IS RECORDED IN PLAT BOOK 4 AT PAGE 1, OFFICE OF THE CLERK OF COURT FOR YORK COUNTY, SOUTH CAROLINA. Being the same property conveyed George Lyles, Jr and Violette W. Lyles by Deed of William E. Cox, Jr and Amelia S. Cox dated February 6, 1978 and recorded March 1, 1978 in Book 566 at Page 503, in the Office of the Register of Deeds for York County, South Carolina. Thereafter, George Lyles, Jr passed away and his interest in the subject property was passed to Violette W. Lyles pursuant to the Will of George Lyles, Jr and by probate of Estate File No. 2007-ES-46-0053. See also Deed of Distribustion dated October 19, 2015 and recorded October 19, 2015 in Volume 15217 at Page 142, in the Office of the Register of Deeds for York County, South Carolina. Thereafter, Violette W. Lyles conveyed the subject property to Violette W. Lyles and Melodee L. Wolbert, as joint tenants with rights of survivorship, by Deed dated October 19, 2015 and recorded October 19, 2015 in Volume 15217 at Page 144, in the Office of the Register of Deeds for York County, South Carolina. Subsequently, Violette W. Lyles passed away and full title passed to Melodee L. Wolbert by operation of law. 104 Overbrook Drive York, SC 29745 TMS# 0701903008 TERMS OF SALE: For cash. Interest at the current rate of 3.375% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for York County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Twenty (20) days, the Master-in-Equity for York County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. If the Plaintiff or the Plaintiff's representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property.
