Notice of Sale C/A No: 2024-CP-46-04158 BY VIRTUE OF A DECREE of the Court of Common Pleas for York County, South Carolina, heretofore issued in the case of Nexus Nova LLC vs. Hector Reyes Hernandez; Mary Faye Francis Wallace; First National Bank of Pennsylvania; Republic Finance LLC I the undersigned as Master-in-Equity for York County, will sell on June 1, 2026 at 11:00 AM at Moss Justice Center 1675 York Hwy, York, South Carolina 29745 to the highest bidder: Legal Description and Property Address: ALL THAT CERTAIN piece, parcel or lot of real property, with any and all improvements that might be situate and located thereon, lying and being on the western side of Kelly Road, in York Township, York County, South Carolina, containing five and 55/100 (5.55) acres, more or less, and being more fully set forth, shown and described on a plat of survey entitled "Property Surveyed for Donald N. Hurst & Jennie L. Hurst", prepared by J.B. Fisher, Surveyor, dated June 2, 1997, and recorded in Record Book A-232, at Page 3, in the Office of the Clerk of Court for York County, South Carolina, which plat is incorporated herein by reference as a part of this description. THIS BEING the same property conveyed unto Hector Reyes Hernandez and Mary Faye Francis Wallace by virtue of a Deed from Gloria Jean Puckett dated June 30, 2020, and recorded July 1, 2020, in Book RB 18386 at Page 278 in the Office of the Clerk of Court for York County, South Carolina. 790 Kelly Road York, SC 29745 TMS# 293-00-00-026 TERMS OF SALE: For cash. Interest at the current rate of 2.99% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for York County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Twenty (20) days, the Master-in-Equity for York County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property.
