STATE OF SOUTH CAROLINA COUNTY OF YORK IN THE COURT OF COMMON PLEAS CASE NO. 2025-CP-46-03821 NewRez LLC d/b/a Shellpoint Mortgage Servicing Plaintiff, Candace Louann Alwran Defendant NOTICE OF SALE BY VIRTUE of a judgment heretofore granted in the case of NewRez LLC d/b/a Shellpoint Mortgage Servicing vs. Candace Louann Alwran, I, Teasa Weaver, Master in Equity for York County, will sell on June 01, 2026, at 11:00 AM, at the Moss Justice Center, 1675 York Highway, York, SC 29745, Courtroom C, to the highest bidder. ALL that certain piece, parcel, lot or tract of land lying, being and situate in York County, S. C., and being shown and designated as Lot 7 on Plat of Wintercrest Subdivision, Phase 11, prepared by R.H. Marett April 30, 1975, and revised June 17, 1976; also shown on plat of property surveyed for Virginia E. White by J.B. Fisher dated May 12, 1994, and recorded in Plat Book 121 at Page 705, and being more particularly described according to said plat as follows, to wit: BEGINNING at a point on Terrell Place, joint front corner of Lots 7 and 8 and running thence with the right of way for Terrell Place curving in a counterclockwise direction with a radius of 50.00 feet for a distance of 70.33 feet to a point; thence N. 13-07-00 W. 143.30 feet to a point; thence N. 65-09- 30 E. 197.50 feet to a point; thence S. 22-13-35 E. 200.05 feet to a point; thence S. 67-50-49 W. 178.14 feet to the point of beginning. SAME PROPERTY BEING SHOWN MORE RECENTLY AS LOT 7, WINTERCREST SUBDIVISION, on a Plat of Survey for Erica J. Stiley and James S. Stokes drawn by David S. Thomas, SCPLS, of Thomas land Surveying, dated January 7, 2011, recorded in Plat Book E78 at Page 7 in the aforesaid Clerk's Office: which said plat is incorporated herein by this reference and having such metes, bounds, courses and distances as by this reference to said plat will more fully appear. Derivation: This being the same property conveyed to Opendoor Property Trust I, a Delaware Statutory Trust by Deed of Erica J. Stiley and James S. Stokes dated August 24, 2023 and recorded August 28, 2023 in Deed Book 20920 at Page 478-480 in the Register of Deeds for York County. And also by deed from Opendoor Property Trust I, a Delaware Statutory Trust to Grantors/Mortgagors herein, dated December 7, 2023 and recorded December 11, 2023 in Book 21077 at Page 155. TMS #: 542-01-01-005 2266 Terrell Place, Rock Hill, SC 29732 SUBJECT TO YORK COUNTY TAXES TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five (5%) of his bid, in cash or equivalent, as evidence of good faith, the same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of noncompliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms or the bid within thirty (30) days, then the Master in Equity may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the former highest bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. A personal or deficiency judgment having been demanded by the Plaintiff, the sale of the subject property will remain open for thirty (30) days pursuant to Section 15-39-720, Code of Laws of South Carolina, 1976; provided, however, that the Court recognizes the option reserved by the Plaintiff to waive such deficiency judgment prior to the sale, and notice is given that the Plaintiff may waive in writing the deficiency judgment prior to the sale; and that should the Plaintiff elect to waive a deficiency judgment, without notice other than the announcement at the sale and notice in writing to the debtor defendant(s) that a deficiency judgment has been waived and that the sale will be final, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. NOTICE: The foreclosure deed is not a warranty deed. Interested bidders should satisfy themselves as to the quality of title to be conveyed by obtaining an independent title search well before the foreclosure sale date. The successful bidder will be required to pay interest on the amount of the bid from the date of sale to date of compliance with the bid at the rate of 7.50000% per annum.
