NOTICE OF SALE
BY VIRTUE of the Order heretofore granted in the case of Perfect Investment Fund, LLC vs. Usmani Holdings, LLC a/k/a Usmani Holdings LLC and Joshua M. Toman, Case No. 2025-CP-46-04710, the undersigned as Master-in-Equity, or her designee, will offer for sale at public auction at the Moss Justice Center, 1675 York Highway, Courtroom C, York, South Carolina 29745, on June 1, 2026, at 11:00 a.m., the following-described property, to-wit:
ALL that piece, parcel or tract of land located on the western side of U.S. Highway 321, Kings Mountain Township, County of York, State of South Carolina and having the following courses and distances to-wit: Beginning at an iron in or near the center of the railroad bed of C & NW Railway Company, this being the southwest comer of the property hereinafter described and running from said beginning iron along lines in said railroad bed as follows: N. 25-08 E. 200 feet to a point; thence N. 33-22 E. 200 feet to a point; thence N 42-53 E. 295.6 feet to a nail in railroad bed; thence S. 44-10 E. 363.5 feet to a point in the center of U.S. Highway 321; thence along a line in the center of said highway S. 24-28 W. 721 feet to a point in U.S. Highway 321; thence N. 44-53 W. 497 feet to the beginning iron. The above-described tract represents Tract #4 on the plat of the property of E.E. Ford, M.B. Hall, Jr. and C.R. Hinshaw, Jr. as drawn by John Quinn Hall, RS and dated June 15, 1970. By reference said plat is incorporated herein and made a part of this description of the subject property.
LESS AND EXCEPT all that certain piece, parcel or tract of land, together with improvements thereon, located in the Town of Clover, County of York, State of South Carolina being shown and described as Lot 4 on that certain plat of survey prepared by James J. Pittman, PLS entitled "Subdivision Survey: The Ward Companies, Bradbury Park" dated September 12, 2008, and recorded October 3, 2008, in Plat Book D-350 at Page 2, to which plat reference is made for a more complete and accurate description of the within described property.
The above property is also described as all those certain pieces, parcels or tracts of land, together with improvements thereon, located in the Town of Clover, County of York, State of South Carolina being shown and described as the Common Areas and Lots 1, 2 and 3 on that certain plat of survey prepared by James J. Pittman, PLS entitled "Subdivision Survey: The Ward Companies, Bradbury Park" dated September 12, 2008, and recorded October 3, 2008, in Plat Book D-350 at Page 2, to which plat reference is made for a more complete and accurate description of the within described property.
LESS AND EXCEPT that certain parcel containing 0.437 acre, more or less, shown as "Area of Acquisition" on Exhibits A-E to that certain Title to Real Estate from Usmani Holdings, LLC in favor of York County dated August 11, 2017, and recorded September 6, 2017, in Record Book 16575, Page 415, York County Records.
BEING a portion of the same property conveyed to Usmani Holdings, LLC by deed of First Citizens Bank and Trust Company, Inc. dated May 24, 2017, and recorded May 30, 2017, in Record Book 16397, Page 458, York County Records.

SUBJECT TO YORK COUNTY TAXES, ASSESSMENTS, AND EASEMENTS AND RESTRICTIONS OF RECORD.
TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Court, at the conclusion of the bidding, five (5%) percent of the bid, in cash or its equivalent, as evidence of good faith, same to be applied to the purchase price only in case of compliance with the bid, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or to comply with the other terms of the bid within thirty (30) days, then the Master-in-Equity or his designee may resell the Property on the same terms and conditions on some subsequent date to be determined by the Court.
As the right to seek a deficiency judgment has been demanded, the bidding will remain open for thirty (30) days after the sale, unless waived by the Plaintiff, in writing, prior to the sale.
Purchaser to pay for preparation of the judicial Deed, any documentary stamps on the Deed, recording of the Deed, and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 8.25% per annum.
