NOTICE OF SALE 2023-CP-46-01045 BY VIRTUE of a decree heretofore granted in the case of: Federal Home Loan Mortgage Corporation, as Trustee for the benefit of the Freddie Mac Seasoned Loans Structured Transaction Trust, Series 2021-1 against Scott D. Kramer, Kelly M. Kramer, The South Carolina Department of Revenue, and Baxter Community Association, Inc., I, the undersigned Master in Equity for York County, will sell on May 11, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land, together with the improvements thereon, lying and being situate in the State of South Carolina, County of York, Fort Mill Township and being designated as Lot 578, Phase XV Baxter Village and according to a survey thereof recorded in Plat Book C257 at Page 6 in the office of the Clerk of Court for York County, South Carolina. Being the same property conveyed to Scott D. Kramer by deed of S.E. Miller Construction, Inc., dated September 13, 2004 and recorded September 15, 2004 in Deed Book 6550 at Page 268; thereafter, Scott D. Kramer conveyed an undivided one-half interest in the subject property to Kelly M. Kramer by deed dated June 7, 2007 and recorded June 15, 2007 in Deed Book 9178 at Page 281; thereafter, Scott D. Kramer and Kelly M. Kramer conveyed the Property to Scott D. Kramer, which deed was recorded July 11, 2016 in Deed Book 15783 at Page 165. TMS No. 655-00-00-171 Property Address: 1140 Market Street, Fort Mill, SC 29708 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 4.2500%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. Since a deficiency judgment is being demanded, the bidding will remain open for thirty (30) days after the date of sale, pursuant to S.C. Code ANN. Section 15-39-720, (1976). The deficiency judgment may be waived by the Plaintiff upon written request prior to sale. NOTICE: The foreclosure deed is not a warranty deed. Interested bidders should satisfy themselves as to the quality of title to be conveyed by obtaining an independent title search well before the foreclosure sale date.
