NOTICE OF SALE
CIVIL ACTION NO. 2025-CP-46-03936 BY VIRTUE of the judgment granted in Bank of America, N.A. vs. Monika Thornton; Jennifer Thornton; Hunters Chase Condominium Homeowners Association, Inc., the Master In Equity for York County, South Carolina, will sell on April 6, 2026 at 11:00 AM, or on another date approved by the Court, at the Master in Equity's Office, Moss Justice Center, Courtroom C, 1675 York Hwy, City of York, State of South Carolina, to the highest bidder:
All that certain piece, parcel or lot of land lying, being and situate in Ebenezer Township, York County, South Carolina, and being a certain condominium unit designated as Unit 1746, Section One, Hunter Chase Horizontal Property Regime, as shown in Plat Book 77 at Page 166, and being a part of Hunters Chase Horizontal Property Regime, established pursuant to Title 27, Chapter 31, Code of Laws of South Carolina (1976, as amended), dedicated by Master Deed recorded in the Office of the Clerk of Court for York County, South Carolina, in Book 824 at Page 122, together with an undivided percentage interest in the common elements appurtenant to said Unit as set forth in said Master Deed, and together with all rights and entitlements, and subject to all easements, conditions, and restrictions as set forth in said Master Deed.
This being the same property conveyed to Kirtley Thornton by deed of Penny P. Baker a/k/a Penny Pressley Baker dated March 10, 2023, and recorded March 13, 2023, in Book 20656 at Page 79 in the Office of the Clerk of Court for York County, South Carolina. Thereafter, Kirtley Thornton died on March 30, 2023, leaving the subject property to his heirs or devisees, Monika Thornton and Jennifer Thornton, as is more fully preserved in Probate File No. 2023-ES-46-01003 and in the Deed of Distribution dated August 18, 2024, and recorded September 6, 2024, in Book 21497 at Page 367 in said Records.

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of its bid, in cash or equivalent to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and applied first to the costs of sale and the balance of Plaintiff's debt. If the highest bidder fails to comply with the bid within twenty (20) days, the Master In Equity may re-sell the property on some subsequent sales day.
No personal or deficiency judgment being demanded, the bidding shall be final on the sale date, and the successful bidder may comply immediately.
Purchaser to pay for documentary stamps on the deed. The sale shall be subject to taxes, assessments, easements and restrictions of record, and any senior encumbrances.
If an agent of Plaintiff does not appear at the sale, the property shall be withdrawn and sold at the next available sales date upon the same terms and conditions.
