NOTICE OF SALE 2025-CP-46-00182 BY VIRTUE of a decree heretofore granted in the case of: Bank of America, N.A. against Fred Owusu Mensah, Regina A. Owusu-Mensah, and Bank of America, N.A., I, the undersigned Master in Equity for York County, will sell on April 6, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: ALL THAT CERTAIN piece, parcel or lot of land lying, being and situate in the State of South Carolina, County of York, being designated as Lot 26 on plat of Deertrack Subdivision, Section 3, and according to a survey thereof prepared by J. B. Fisher, SCRLS, dated October 30, 1991, recorded in Plat Book 100, page 428, having the following courses and distances, to wit: BEGINNING at an old iron on the eastern side of Deertrack Drive, joint front corner of Lots 26 and 27, and running thence with Deertrack Drive N. 24-02-48 E. 120.05 feet to an old iron at the joint front corner of Lots 25 and 26; thence S. 65-55-41 E. 328.00 feet to an old iron; thence S. 05-24-54 W. 126.67 feet to an old iron; thence N. 65-55-59 W. 368.47 feet to the point of beginning. This being the same property conveyed to Fred Owusu Mensah and Regina A. Owusu-Mensah by Deed of Timothy S. Hawkins and Tammy M. Hawkins dated January 30, 1998 and recorded February 6, 1998 in Record Book 2127, page 106 in the Office of the Clerk of Court for York County, South Carolina TMS No. 590-00-00-077 Property Address: 1064 Deertrack Drive, Rock Hill, SC 29732 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 7.3750%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. No personal or deficiency judgment being demanded, the bidding will conclude at the fall of the gavel on the date of the sale. Compliance with the bid may be made immediately. NOTICE: The foreclosure deed is not a warranty deed.
