NOTICE OF SALE
2025-CP-46-03809 BY VIRTUE of a decree heretofore granted in the case of: Carolina Capital Reserve Fund I, LLC against Davis & Daughters, LLC and Jonathan Davis, I, the undersigned Master in Equity for York County, will sell on April 6, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land lying, being and situated in the City of Rock Hill, Catawba Township, York County, South Carolina, same being more particularly described as being Lots 12 and 13, Block 2 upon plat of property of Carroll Park prepared by Miller & White, June, 1911, recorded in Plat Book C, page 124. Said plat is by reference incorporated herein as part of this description. This being the same property conveyed to Davis & Daughters, LLC by deed of GBM Land and Construction, LLC recorded May 5, 2023 in Book 20740 at Page 430. TMS No. 600-07-01-020 Property Address: 269 Carroll Street, Rock Hill, SC 29730 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 10.0000%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. Since a deficiency judgment is being demanded, the bidding will remain open for thirty (30) days after the date of sale, pursuant to S.C. Code ANN. Section 15-39-720, (1976).
