NOTICE OF PENDENCY OF ACTION NOTICE IS HEREBY GIVEN THAT an action has been commenced and is now pending or is about to be commenced in the Circuit Court upon the complaint of the above named Plaintiff against the above named Defendant for the purpose of foreclosing a certain mortgage of real estate heretofore given by Leigh Richards and Courtney Leigh Smith, as co-trustees of the Leigh Richards Revocable Trust Under Trust Instrument Dated 09/01/2020 to Athene Annuity and Life Company bearing date of September 22, 2022 and recorded December 7, 2022 in Mortgage Book 20533 at Page 436 in the Register of Mesne Conveyances/Register of Deeds/Clerk of Court for York County, in the original principal sum of Two Hundred Thousand and 00/100 Dollars ($200,000.00). Thereafter, by assignment recorded on September 25, 2025 in Book 22155 at Page 218, the mortgage was assigned to the Plaintiff., and that the premises effected by said mortgage and by the foreclosure thereof are situated in the County of York, State of South Carolina, and is described as follows: BEING all that certain piece, parcel or tract of land lying, being and situated in YORK County, South Carolina, and being shown and designated as Lot 19, fronting on Joe Louis Street (Formerly African Street), containing .247 acre, as shown in Plat Book E 250 Page 9; in the Office of the Clerk of Court, YORK, County, South Carolina and having such metes and bounds, coursed and distance as reference to said plat will more fully appear; reference to which plat is hereby made for a more particular description.
