NOTICE OF SALE

BY VIRTUE of that certain Decree of the Court of Common Pleas for York County, South Carolina, heretofore granted in the case of Founders Federal Credit Union v. Michael Bailey, Amanda Bailey and South Carolina Department of Revenue, I, the undersigned Master in Equity for York County, South Carolina or my agent, will sell on January 5, 2026, at 11:00 a.m., at the Moss Justice Center, 1675 York Highway, York, SC 29745, to the highest bidder, the following described property:
All that certain piece, parcel, or lot of land lying, being and situate on the northern side of Timber Ridge Lane, in York County, South Carolina, and being shown and described on plat of property of Susan S. Atkinson and David W. Atkins, drawn by J. B. Fisher, SCRLS, dated March 28, 1990 and being more particularly described according to said plat, as follows, Beginning at an old iron on the northern side of Timber Ridge Lane across from its intersection with Brynwood Drive and running thence along Timber Ridge Lane (existing right way and thence running into proposed right of way), following the counterclockwise curvature thereof (radius-472.20 feet) for an arc distance of 156.71 feet to an old iron and thence continuing along the proposed right of way running from the end of Timber Ridge Lane, S. 86-28-06 W. 297.42 feet to a point in a creek (there being an old iron found 20.00 feet before reaching said creek); thence running along said creek N. 13-09-39 E. 63.20 feet to a point; thence running N. 57-25-02 E. 495.30 feet to an old iron (there being an old iron found 10.0 feet after leaving said creek); thence running S. 58-10-56 E. 200.02 feet to an old iron; thence running S. 34-08-43 W. 266.71 feet to the point of beginning; being designated as Lot 17 on Plat of Woodbridge Subdivision, Section I, recorded in Plat Book 54, page 12.
Derivation: Deed of Suzan S. Atkinson (Grantor) to Michael Bailey and Amanda Bailey (Grantee) dated August 22, 2003 and recorded on September 9, 2023, in Book 5657 at Page 0220, in the Office of the Clerk of Court for York County, SC.

TERMS OF SALE: The successful bidder, other than Plaintiff, will deposit with the Master in Equity or her agent, at the conclusion of the bidding, five (5%) percent of the bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of noncompliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity or her agent may resell the property on the same terms and conditions on some subsequent sales day at the risk of the said highest bidder.
The sale shall be subject to York County taxes and assessments and to existing easements and restrictions of record.
PURSUANT TO S.C. CODE ANN. § 15-41-10, ET SEQ. REGARDING EXEMPTIONS, THE MINIMUM BID FOR THIS PROPERTY MUST BE IN THE AMOUNT OF THE HOMESTEAD EXEMPTION AND NO BIDS FOR THIS PROPERTY LESS THAN THE AMOUNT OF THE HOMESTEAD EXEMPTION WILL BE ACCEPTED.
ADDITIONALLY, THE SALE OF THE SUBJECT PROPERTY THROUGH THIS FORECLOSURE ACTION WILL BE MADE SUBJECT TO A FIRST MORTGAGE AND DEFENDANT M. BAILEY'S HOMESTEAD EXEMPTION RIGHT.
Purchaser to pay for the preparation of the Deed, documentary stamps on the Deed, recording of the Deed, and interest on the balance of the bid from date of sale to date of compliance with the bid at the legal rate of interest of 7.5% per annum.
Attention is drawn to the Court Order on file with the Clerk of Court for York County. The terms and conditions of the actual Court Order, to the extent of any inconsistencies, control over any terms or conditions contained in the Notice of Sale.
As this is a judicial lien foreclosure action, the bidding will not remain open and the sale will close on the day of the sale. Any proceeds realized from the sale of the property will be used and applied to reduce the amount of the judgment.
If Plaintiff or its representative does not appear at the scheduled sale of the above-described property, then the sale of the property will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day.
