AMENDED NOTICE OF SALE 2023-CP-46-02976 BY VIRTUE of a decree heretofore granted in the case of: Kirkland Financial LLC against Milorad M. Zarkovacki aka Michael Zarkovacki, MV Realty of South Carolina, LLC, Charlotte Mecklenburg Hospital Authority d/b/a Atrium Health, American Express National Bank, Citibank, NA and Baxter Community Association, Inc, I, the undersigned Master in Equity for York County, will sell on January 5, 2026, at 11:00 a.m., or on another date, thereafter as approved by the Court, at the Moss Justice Center, 1675 York Highway in York, South Carolina, 29745, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or tract of land, together with improvements thereon, situate, lying and being in the County of York, State of South Carolina, being shown and designated as Lot 522 on a plat of Baxter Town Center, Phase 10 prepared by LandDesign Surveying,Inc. dated February 19, 2003 and recorded in the Office of Deeds for York County in Plat Book C-173 at Page 10. Being more particularly shown and delineated on a plat prepared for Susan E. Fuller by David J. Dills, PLS dated May 12, 2004 and recorded in Plat Book 141 at Page 607 and being more particularly shown and delineated on a plat prepared for Chris Corr by Fisher Sherer Inc. dated November 6, 2012 and recorded in Plat E167 at Page 2. Reference is made to said latter plat for more complete and accurate description. Be all measurements a little more or less. Office of the Clerk of Court for York County, South Carolina and incorporated herein by reference. Being the same property conveyed to Milorad M. Zarkovacki aka Michael Zarkovacki by deed of Amy L. Zarkovacki dated February 2, 2021 and recorded February 16, 2021 in Deed Book 19003 at Page 468 TMS No. 655-13-01-066 Property Address: 613 Bracket Street, Fort Mill, SC 29708 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Master in Equity may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 2.8750%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES.
