Notice of Sale C/A No: 2025-CP-46-02982 BY VIRTUE OF A DECREE of the Court of Common Pleas for York County, South Carolina, heretofore issued in the case of M&T Bank vs. Sheri Smith; Alexis Smith; The United States of America, by and through its Agency, the Department of Housing and Urban Development; Ivy Ridge Townhomes Association, Inc.; Rameses Development, L.L.C; Cypress Pointe Community Association, Inc. I the undersigned as Master-in-Equity for York County, will sell on January 5, 2026 at 11:00 AM at Moss Justice Center 1675 York Hwy, York, South Carolina 29745 to the highest bidder: Legal Description and Property Address: ALL that certain parcel of land lying, being and situated in the Township of Bethel, County of York, State of South Carolina, and being shown and designated as Lot 76, on that certain plat entitled "FINAL PLAT FOR THE VILLAGE AT IVY RIDGE" prepared by ESP Associates, Inc., dated and recorded November 7, 2019 in Plat Book 162 at Page 403, in the Office of the Clerk of Court for York County, South Carolina, which plat is incorporated herein by reference, and having such metes, bounds, courses and distances as by reference to said plat will more fully appear. This being the same property conveyed to Sheri Smith, Alexis Smith and Leona Barcomb, as joint tenants with rights of survivorship, and not as tenants in common, by deed of D.R. Horton, Inc., dated November 5, 2021 and recorded November 8, 2021 in Deed Book RB 19747 at Page 261, in the Office of the Register of Deeds for York County, South Carolina. Thereafter, Leona Barcomb passed away and full title passed to Sheri Smith and Alexis Smith by operation of law. 592 Altamonte Drive Lake Wylie, SC 29710 TMS# 5752001171 TERMS OF SALE: For cash. Interest at the current rate of 3.375% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for York County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Twenty (20) days, the Master-in-Equity for York County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record.
