STATE OF SOUTH CAROLINA COUNTY OF YORK IN THE COURT OF COMMON PLEAS, 2025-CP-46-04246 and 2025-CP-46-04244; Ruskin A. Belk, Plaintiff vs. Jacqueline Meeks Jones, Roscoe D. Meeks, James Weldon Meeks, deceased, Rosa Meeks Jefferson, deceased and Esther Meeks Herbin, deceased, including his or her spouse, if any he or she had, and if he, she or they be dead (as defendants whose names are unknown) and children and heirs at law and/or distributees of the deceased, including his or her spouse, if married, and if he, she or they be dead, and all persons claiming any right, title, estate interest in or lien upon the real estate described; any unknown adults, being a class designated as John Doe and any unborn infants or persons under disability being a class designated as Richard Roe, Defendants. SUMMONS AND NOTICES: TO THE DEFENDANTS ABOVE NAMED: YOU ARE HEREBY SUMMONED and required to appear and defend by answering the Complaint in this action, a copy of which is herewith served upon you, and to serve a copy of your Answer to said Complaint upon the subscriber at his office located at 1721 Ebenezer Road, Suite 295, Rock Hill, S.C. 29732, within thirty (30) days after the service hereof, exclusive of the day of such service; and if you fail to do so, judgment by default will be rendered against you for the relief demanded in the Complaint. TO ANY UNKNOWN MINORS, UNKNOWN ADULTS, PERSONS UNDER A DISABILITY OR IN THE MILITARY SERVICE, IF ANY, HEREIN COLLECTIVELY DESIGNATED AS JOHN DOE AND RICHARD ROE: YOU ARE FURTHER SUMMONED and notified that the Plaintiff has applied for the appointment of a Guardian ad Litem Nisi to represent said Defendants; and if you fail to apply for appointment of a Guardian ad Litem within thirty (30) days after the service of this Summons and Notice upon you, the Plaintiff's appointment will be made absolute with no further action from the Plaintiff. ORDER APPOINTING GUARDIAN AD LITEM NIS AND ORDER FOR SERVICE BY PUBLICATION It appearing to the satisfaction of the Court upon reading the Petition of the Plaintiff for the appointment of Neil T. Phillips, Esquire, as Guardian ad Litem Nisi for any unknown minors, unknown adults, persons under a disability or in the military service, if any, and any known Defendants upon whom service has not been effected, herein collectively designated as John Doe and Richard Roe, and it appearing that the names and addresses of such Defendants and any unknown minors, unknown adults, persons under a disability or in the military service, if any, whether residents or non-residents of the State of South Carolina, are unknown to the Plaintiff and cannot with reasonable diligence be ascertained, and that the said Neil T. Phillips, Esquire, is a suitable and competent person to understand and protect the rights and interest of for any unknown minors, unknown adults, persons under a disability or in the military service, if any, and that he has no interest therein adverse to the interests of said Defendants, if any, and is not connected in business with the Plaintiff in this action or with his counsel. IT IS THEREFORE ORDERED that, Neil T. Phillips, Esquire, be and hereby is designated and appointed Guardian ad Litem Nisi on behalf of any unknown minors, unknown adults, persons under a disability or in the military service, if any, all of whom may have or may claim to have some interest in or claim to the real property at issue in this action; that Neil T. Phillips, Esquire, is empowered and directed to appear on behalf of and to represent said unknown minors, unknown adults, persons under a disability or in the military service, if any, unless they, or someone on their behalf, shall procure the appointment of a Guardian ad Litem for the said Defendants; that should the Defendants fail to procure the appointment of a Guardian ad Litem within thirty (30) days from the date of service by publication, the appointment of Neil T. Phillips, Esquire, as Guardian ad Litem, will be made absolute without further action by the Plaintiff. IT IS FURTHER ORDERED that this Order shall be served upon said Defendants and any unknown minors, unknown adults, persons under a disability or in the military service, if any, herein collectively designated as John Doe and Richard Roe, by publication of such notice of this Order as required by law in The Herald, a newspaper published in York, SC, once a week for three (3) successive weeks. YOU WILL PLEASE TAKE NOTICE that the foregoing Summons, along with the Complaint were filed with the Clerk of Court for York County, SC on October 31, 2025, and are available for review by all interested persons.
