STATE OF SOUTH CAROLINA COUNTY OF YORK IN THE COURT OF COMMON PLEAS CASE NO.: 2025-CP-46-01559 AMENDED NOTICE OF SALE Deficiency Judgment Waived New Day Financial, LLC, Plaintiff, v. Edward Cephas, III and if Edward Cephas, III be deceased then any and all children and heirs at law, distributees and devisees and if any of the same be dead, any and all persons entitled to claim under or through them, also all other persons unknown claiming any right, title, interest or lien upon the real estate described in the complaint herein, any unknown adults, any unknown infants or persons under disability, being a class designated as John Doe or persons in the military service of the United States of America, being a class designated as Richard Roe; Angela Hartsfield, Individually as an Heir of Edward Cephas, III, and also as Personal Representative of the Estate of Edward Cephas, III, Defendant(s). BY VIRTUE of the decree heretofore granted in the case of: New Day Financial, LLC vs. Edward Cephas, III and if Edward Cephas, III be deceased then any and all children and heirs at law, distributees and devisees and if any of the same be dead, any and all persons entitled to claim under or through them, also all other persons unknown claiming any right, title, interest or lien upon the real estate described in the complaint herein, any unknown adults, any unknown infants or persons under disability, being a class designated as John Doe or persons in the military service of the United States of America, being a class designated as Richard Roe and Angela Hartsfield, Individually as an Heir of Edward Cephas, III, and also as Personal Representative of the Estate of Edward Cephas, III, the undersigned Master in Equity for York County, South Carolina, will sell on December 8, 2025 at 11:00 am at the Moss Justice Center, 1675 York Highway, York, South Carolina 29745 to the highest bidder: The land referred to herein below is situated in the County of York, State of South Carolina and is described as follows: Being all of Lot 31-A of Camellia Corners, as shown on plat thereof recorded in Plat Book 159, Page 200 in the York County Public Registry, South Carolina, which Plat is incorporated herein by reference and made a part of this description. This being the same property conveyed to Edward Cephas, III by deed of Paulus Roberto Gueiros Anglada dated May 29, 2019 and recorded May 29, 2019 in Book RB 17567, Page 476, in the York County Records. Subsequently thereafter, Edward Cephas died. Probate has been opened in Case Number 2024-ES-46-01511, York County, South Carolina. No deed of distribution has been recorded at this time. PROPERTY ADDRESS: 1267 Camellia Ct, 31A, Rock Hill, SC 29732 TMS#: 595-10-01-028 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail to comply with the other terms of the bid within twenty (20) days, then the Master in Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The sale shall be subject to taxes and assessments, existing easements and restrictions of record, and any other senior encumbrances. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. In the event an agent of Plaintiff does not appear at the time of sale, the within property shall be withdrawn from sale and sold at the next available sales date upon the terms and conditions as set forth in the Master in Equity's Order and Judgment of Foreclosure and Sale or such terms as may be set forth in a supplemental order. This sale is subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given.
