PUBLIC NOTICE – PUBLIC HEARING TOWN OF APEX, NORTH CAROLINA APEX, N.C. (September 3, 2026) – The Town Council of Apex, North Carolina has scheduled a Public Hearing to be held at 6:00 p.m. at Apex Town Hall, 73 Hunter Street, on the 22nd day of September, 2026, on the following action: POTENTIAL ISSUANCE OF LIMITED OBLIGATION BONDS PURSUANT TO SECTION 160A-20 OF NORTH CAROLINA GENERAL STATUTES The Town Council of the Town of Apex, North Carolina (the "Town") has determined to consider whether to issue limited obligation bonds (the "Bonds") pursuant to Section 160A-20 of the General Statutes of North Carolina, as amended, for the purpose of providing funds, together with any other available funds, to (a) pay the costs of (i) acquiring, constructing, renovating and equipping improvements to Town Hall and the Tunstall House, (ii) various streets and sidewalk improvements, including, but not limited to, Salem Street streetscaping, and (iii) acquiring property for a future Public Safety Station (collectively, the "Project") and (b) pay certain financing costs relating thereto. The Town would be obligated to pay debt service on the proposed Bonds in a principal amount not to exceed $16,000,000, together with interest thereon. The Town proposes to enter into a new Trust Agreement (the "Trust Agreement") and to issue its Bonds thereunder to carry out the installment contract financing. The Town will reserve in the Trust Agreement the right to issue additional limited obligation bonds from time to time for the purpose of providing additional funds to finance the cost of acquiring, constructing and equipping additional improvements for the Town, refund other limited obligation bonds and refinance other installment financing obligations of the Town. If the Town enters into the Trust Agreement, it will secure its obligations thereunder and under the Bonds by executing and delivering a deed of trust granting a lien of record on all or a portion of the Project, together with all improvements or fixtures located or to be located thereon, subject to certain permitted encumbrances. Section 160A-20 of the General Statutes of North Carolina requires that the Town hold a public hearing prior to issuing the Bonds. Anyone who wishes to be heard may appear at this public hearing at 6:00 p.m. on September 22, 2026, in the Council Chambers of the Town Hall located at 73 Hunter Street in Apex, North Carolina. Residents may submit written comments to the Town Council with attention marked to the Town Clerk Allen Coleman; P.O. Box 250; Apex, NC 27502 or by email at public public.hearing@apexnc.org. Please use subject line "Potential Bond Issuance - $16M" and include your first and last name, your address, and your phone number in your written statements. Written comments will be accepted until 3:00 PM on Tuesday, September 22, 2026.
