This project is being funded in whole or in part by the Community Development Block Grant Program (CDBG). All Federal CDBG requirements will apply to the contract: BIDDERS on this work will be required to comply with Section 109 and E.O. 11246 which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. BIDDERS must comply with Title VI of the Civil Rights Act of 1964, Davis Bacon Act, Anti-Kickback Act, and Contract Work Hours and Safety Standards Act. The Town of Fountain is committed to and supportive of efforts to effectively maintain and/or increase the use of Small and Minority/Women-Owned Business, Veteran-Owned Business, and Historically Underutilized Businesses (HUB) contract participation for Construction Projects, services (including professional and consulting services) and commodities purchases, AND increase contract participation to offer employment, training and contracting opportunities in accordance with Section 3 of the Housing and Urban Development Act of 1968 (24 C.F.R. Part 135). No contract may be awarded to any contractor that is debarred, suspended or otherwise ineligible to participate in Federally assisted contracts or programs. Any contract awarded to a prime contractor or subcontractor that is found to be ineligible for award must be terminated immediately. Prior to contract award, prime contractors are to be actively registered, with no exclusions, with SAM.gov and not on NC Debarred Vendors list, to determine eligibility/debarment status. The total CDBG program is funded with $775,000 in CDBG funds which represent 100% of the total CDBG program costs. The total CDBG funding amount of $775,000 is a governmental disclosure required by the CDBG program and not the proposed construction cost for contracts referenced by this advertisement. This project is subject to the Build America, Buy America Act (BABA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IIJA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022. NOTE: Iron and Steel is the phased approach to BABA that HUD implemented, manufactured products do not apply. The OWNER reserves the right to reject any and all BIDS. BIDDER shall be properly licensed under Chapter 87, General Statutes of North Carolina. Small, minority, women, veteran-owned, Historically Underutilized Business (HUB), and Section 3 (low income) businesses and labor surplus area firms are encouraged to submit BIDS. This PROJECT is subject to the good faith efforts and goals for participation by minority businesses required by G.S. 143-128.2. The OWNER has adopted a verifiable ten percent (10%) goal for participation by minority businesses in the total value of the WORK. BIDDERS shall, within the time frames specified in the BID documents, submit all required affidavits and documentation demonstrating that the BIDDER made the required good faith effort in compliance with G.S. 143-128.2. Failure to file all required affidavits and documentation within the required time frames is grounds for rejection of the BID.
