NOTICE OF SUBSTITUTE TRUSTEE'S FORECLOSURE SALE OF REAL AND PERSONAL PROPERTY 25SP-1173-310 UNDER AND BY VIRTUE of the power and authority contained in that Deed of Trust by K&J Poston Properties LLC ("Borrower"), dated February 27, 2024 securing an indebtedness to Loan Mountain Investments Sub-REIT LLC in the original principal amount of $288,750.00 and recorded on March 5, 2024, in Book 10063 , at Page 518 of the Durham County Public Registry (the "Deed of Trust"); and because of default in the payment of the indebtedness secured thereby and failure to carry out and perform the stipulations and agreements contained therein and, pursuant to demand of the holder of the indebtedness secured by said Deed of Trust, the undersigned Substitute Trustee will place for sale, at public auction, to the highest bidder for cash at the usual place of sale at Durham County Courthouse, in Durham North Carolina, on Tuesday April 7 at 11:00 A.M. those parcels of land, including all of Borrower's right, title and interest now owned or hereafter acquired in and to the property, including all estates, rights, tenements, hereditaments, privileges, easements, and appurtenances of any kind benefitting the property, all means of access to and from the property, whether public or private and all water and mineral rights, situated, lying and being in Durham County, North Carolina, and being more particularly described as follows: BEGINNING at iron stake on the southern right of way of Hart Street, said iron stake being South 88 deg. 50' East 345 feet from the intersection of the southern side of Hart Street, (extended); and the eastern side of Maple Street (extended); running thence South 1 deg. 10' West 146.67 feet to a point; running thence South 77 deg. 38' 20" East 44.21 feet to an iron stake; running thence North 0 deg. 26' 50" West 155.33 feet to an iron stake on the southern side of Hart Street; running thence along and with said side of said street, North 88 deg. 50' West 39 feet to an iron pin, the point and place of BEGINNING and being that property shown on the loan survey for Paul D. Johnson and wife Carol R. Johnson as surveyed by Robert W. Young, L.S., dated July 12, 1980, to which survey reference is hereby made for a more particular description, said survey recorded in Book 1034, Page 208, Durham County Registry. Present Record Owner: K&J Poston Properties LLC Property Address: 1914 Hart St, Durham, NC 27703 The terms of the sale are that the real property hereinbefore described will be sold for cash to the highest bidder. The sale of the personal property is made in accordance with G.S. § 25-9-604 (a) and (b). A deposit of five percent (5%) of the amount of the bid or Seven Hundred Fifty Dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale. In the event that the Holder or its intended assignee is exempt from paying the same, the successful bidder shall be required to pay revenue stamps on the Trustee's Deed, and any Land Transfer Tax. The real property hereinabove described is being offered for sale "AS IS, WHERE IS" and will be sold subject to all superior liens, unpaid taxes, and special assessments. Other conditions will be announced at the sale. The sale will be held open for ten (10) days for upset bids as by law required. If the Trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the sale and reinstatement of the loan without the knowledge of the Trustee. If the validity of the sale is challenged by any party, the Trustee, in its sole discretion, if it believes the challenge to have merit, may declare the sale to be void and return the deposit. The purchaser will have no further remedy. Additional Notice Where the Real Property is Residential With Less Than 15 Rental Units: An order for possession of the property may be issued pursuant to G.S. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 days' written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
