NOTICE OF TAX FORECLOSURE SALE
Under and by virtue of a Judgment entered in the action entitled "County of Durham and City of Durham vs. Shoenice N. Carroway and State Employees' Credit Union, " File No. 25CV007448-310, the undersigned Commissioner will, on the 10th day of February, 2026, offer for sale and sell for cash, to the last and highest bidder at public auction, at the Durham County Justice Center, 510 South Dillard Street, in Durham, North Carolina, at 12:00 o'clock, Noon, the following described real property, lying and being in the County of Durham, State of North Carolina, and more particularly described as follows:

LYING on the western side of Nixon Street, and being all of that property shown on a plat entitled "Property of W.W. BARBEE and ADDIE BARBEE," dated August 6, 1966, drawn by George C. Love, Jr., Registered Land Surveyor, and being duly filed for record in Plat Book 54 at page 40 in the Office of the Register of Deeds of Durham County, TOGETHER WITH all rights and obligations in that Encroachment Agreement recorded in Book 8760 at page 643, Durham County Registry and shown in Plat Book 200 at page 119, Durham County Registry, AND SUBJECT TO that 25 foot wide sanitary sewer easement granted to the City of Durham in Book 360 at page 150, Durham County Registry, and shown in Plat Book 64 at page 33, Durham County Registry. Reference is hereby expressly made to the plat and instruments referred to above for a more particular description of same. This property was conveyed to Louis Devone (Jr.) by deed recorded in Book 343 at page 547, Durham County Registry. Louis Devone, Jr. died testate on August 15, 2010, and his will devised this property to Martha C. Devone. Martha C. Devone died testate on October 30, 2013, and her will devised this property to Shoniece N. Carroway.
This sale will be made subject to city and county property taxes for the year 2026 and subsequent years and all local improvement assessments against the above-described property not included in the judgment in the above-entitled cause. A deposit of ten percent (10%) of the successful bid will be required.
