ECD Holding, Inc., executed a deed of trust, recorded on April 19, 2021 in Real Estate Book 9302, Page 217, Durham County Registry. Love Law Firm PC was named the trustee in said deed of trust. By document recorded in Real Estate Book 10361, Page 626, Durham County Registry, Gary Berman was substituted as trustee; he remains the trustee. Pursuant to an order of the Durham County Clerk of Superior Court, entered on November 25, 2025, and under the power and authority vested by said deed of trust, the trustee will sell the real property described in said deed of trust. The real property is the following parcel (together with all privileges and appurtenances thereto):
BEING all of Lots 7A and 7B as per plat recorded in Plat Book 192, Page 306, Durham County Registry.
The addresses of these lots are 4104 and 4100 Fiesta Road, Durham, North Carolina.
The trustee will offer the real property for sale at public auction to the highest bidder for cash at the courthouse door at 510 South Dillard Street, Durham, North Carolina, on December 22, 2025, at 10:10 a.m. A cash deposit of seven hundred fifty dollars will be required of the highest bidder at the public auction. The sale will be subject to all prior liens and encumbrances, and unpaid taxes and special assessments, including any transfer tax associated with the sale, and including the tax required by NCGS 7A-308(a)(1). The property is not being sold subject to or together with subordinate rights or interests. The sale will be held open for 10 calendar days for upset bids. Upon the expiration of the statutory upset bid period, all unpaid amounts are immediately due.
An order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the Durham County Clerk of Superior Court.
Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement upon 10 days' written notice to the landlord. The notice shall also state that upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
