MITIGATED DETERMINATION OF NON-SIGNIFICANCE Anderson Place Preliminary Plat Permit No. TUM-25-1586 May 8, 2026 Description of Proposal: The applicant is proposing a subdivision of two parcels totaling 14.54 acres into 85 single family lots and six community tracts. The development will include infrastructure, frontage improvements, and open space. Applicant: Pinnacle Development Services, LLC, 12118 La France Road SW, Olympia, WA 98512. Location of Proposal: Two parcels totaling 14.54 acres located at 2701 and 2719 70th Ave SW, Tumwater, WA 98512. Tax Parcel Numbers 12704330101 and 12704430801. Lead agency: City of Tumwater, Community Development Department. The lead agency for this proposal has determined that, as conditioned, does not have a probable significant adverse impact on the environment. An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead-agency. This information is available to the public on request. This MDNS assumes that the applicant will comply with all City ordinances and development standards governing the type of development proposed, including but not limited to, street standards, storm water standards, high groundwater hazard areas ordinance standards, water and sewer utility standards, critical areas ordinance standards, tree protection standards, zoning ordinance standards, land division ordinance standards, building and fire code standards, and level of service standards relating to traffic. These ordinances and standards provide mitigation for adverse environmental impacts of the proposed development. Condition of Approval for Mitigating Environmental Impacts: Findings: 1. The Tumwater Boulevard/I-5 northbound ramps intersection currently operates at LOS F during both peak periods for the northbound left-turn movement. The project is projected to add thirty-nine (39) trips to this intersection. The City has recently developed a SEPA improvement project for the Tumwater Boulevard/I-5 interchange that include intersection improvements at the northbound I-5 ramps intersection, with a peak hour per trip impact fee of $4,264 or as required in the most up to date fee schedule at the time of building permit for each trip entering the interchange area. 2. The Priority Habitat Species map shows an occurrence of Mazama Pocket Gopher soil mounds mapped by Washington Department of Fish and Wildlife on the project site. The source date for this occurrence is listed as November 6, 2012. The Mazama Pocket Gopher Assessment Report prepared by Brian Combs, Consulting Biologist, Pacifica Restoration Co., dated November 12, 2018, noted that during field studies completed on September 21, 2018, and October 26, 2018, several clusters of soil mounds that appeared likely to be gopher soil mounds were observed. The consulting biologist noted several soil mounds that they believed were associated with gopher soil activity in their report. Mitigation Measures: 1. Prior to issuance of the Building Permit: i. Construct a roundabout at the northbound Interstate 5 On/Off Ramp and Tumwater Boulevard intersection; or ii. Voluntarily pay a mitigation fee of $4,264 (or as required by the most up to date fee schedule at the time of building permit issuance) per peak trip generated by this project (39) under RCW 82.02.020 to be used as described herein: Tumwater Boulevard/I-5 Interchange: The City's planned transportation improvements at the Tumwater Boulevard/I-5 interchange include converting the interchange to a roundabout diamond interchange by replacing the southbound on/off ramp signal and northbound stop controlled intersections with roundabouts. The project shows 39 trips. 2. Prior to issuance of any permit approving land disturbance on the property, including but not limited to a land clearing permit or a site development grading permit, the applicant shall either obtain federal incidental take coverage for the take of the Mazama pocket gopher from the U.S. Fish and Wildlife Services (USFWS) by an federal incidental take permit or obtain federal incidental take coverage in another form approved by USFWS. This MDNS is issued under WAC 197-11-350; the lead agency will not act on this proposal for 14 days from the date below.
