NOTICE OF PUBLIC HEARING
MODESTO CITY SCHOOLS
NOTICE IS HEREBY GIVEN that the Board of Education ("Board") of the Modesto City Schools ("District"), at its regular meeting on Monday, April 20, 2026, will conduct a public hearing to consider the approval and adoption of the proposed Level 1 Developer Fee Justification Study ("Fee Study"), and the adoption of a Resolution of the Board to approve increased statutory fee rates within the Modesto City Elementary School District (which collects 60% of the maximum statutory fee rate pursuant to a fee sharing agreement) and Modesto City High School District (which collects 40% of the maximum statutory fee rate pursuant to a fee sharing agreement).The Board will consider the proposed fee rate of $3.23 per square foot of assessable space for residential development within Modesto City Elementary School District, and $2.15 per square foot of assessable space for residential development within Modesto City High School District. Fee rates for commercial or industrial construction, depending on the category of construction, are also proposed to be increased up to $0.52 per square foot within Modesto City Elementary School District, and up to $0.87 per square foot within Modesto City High School District, although some areas of the Modesto City High School District may see a lower fee rate based on its agreements with the elementary school districts with which it shares boundaries. The Fee Study will be made available for public review at least ten days prior to consideration by the Board, as required by law, at both the District's Planning and Facilities Office, located at 1311 Woodland Ave, Suite C, in Modesto, and online at the following link: https://www.mcs4kids.com/o/mcs/page/planning.
On Monday, April 20, 2026, the public hearing will begin at 6:00 p.m., or as soon as practicable thereafter, at the Boardroom located at 425 Locust Street in Modesto. Instructions for public comments are on the Board's webpage, and any written comments must be submitted to the Director III, Planning & Internal Audits no later than 5:00 p.m. the day before the public hearing. Any person challenging the approval of the Fee Study or the adjusted statutory fee rates in a court of competent jurisdiction after the conclusion of the public hearing may be limited to only those issues raised at the hearing or in written correspondences received by the District by the submission deadline.
