BID ADVERTISEMENT NOTICE IS HEREBY GIVEN that the City of Modesto, in the County of Stanislaus, State of California, will receive bids for the following work: RETROREFLECTIVE BACKPLATES, LED STOP SIGNS INSTALLATION, RECTANGULAR RAPID FLASHING BEACONS (RRFB), This project is listed on the OpenGov Procurement Portal under “Bid Opportunities” on the City’s website, http://www.modestogov. com/257/Contracting-Bid-Opportunities. THE PAYMENT OF PREVAILING WAGES IS REQUIRED ON THIS PROJECT. The DBE Contract Goal is XX percent. Bidders are advised that, as required by federal law, the City of Modesto is implementing Disadvantaged Business Enterprise requirements. Section 14, “STATE AND FEDERAL REQUIREMENTS & PROVISIONS,” under Subsection titled “Disadvantaged Business Enterprises (DBE)” of the special provisions cover the DBE requirements. THIS PROJECT IS SUBJECT TO THE “BUY AMERICA” PROVISIONS OF THE SURFACE TRANSPORTATION ASSISTANCE ACT OF 1982 AS AMENDED BY THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991.Pursuant to Section 1770 et seq. of the Labor Code of the State of California, the Director of Industrial Relations of the State of California has ascertained the general prevailing rate of hourly wages and rates for legal holidays and overtime work in the locality where this work is to be performed, for each craft or type of worker or mechanic needed to execute the contract which will be awarded the successful bidder. The prevailing rates are on file in the office of the City Clerk, 1010 Tenth Street, Modesto, California, and are available to any interested party on request. Pursuant to Section 1725.5 of the Labor Code of the State of California, the Contractor must register with the Department of Industrial Relations. Pursuant to Section 1771.4 of the Labor Code of the State of California, this project is subject to compliance monitoring and enforcement of the Department of Industrial Relations. It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all laborers and mechanics employed by them in the execution of the contract. The U.S. Department of Transportation (DOT) provides a toll-free Hotline service to report bid rigging activities. Bid rigging activities can be reported Monday through Friday, between 8:00 am and 5:00 pm, Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion or other fraudulent activities should use the hotline to report these activities. The hotline is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and call anonymity will be respected. Bidder’s attention is hereby called to the nondiscrimination clause contained in Section 7 of the General Provisions of the City Standard Specifications. The Bidder shall check the project listing on the City’s website the day prior to bid opening to obtain any addenda information. Completion of the addenda acknowledgement section of the Bid Form shall be evidence that the bidder has obtained this information and that the bid is based on any changes contained therein. Bidders may be required to furnish a sworn statement of their financial responsibility, technical ability and experience before award is made to any particular bidders. Before entering into a contract for the work, Contractors shall be licensed in accordance with the provisions of Sections 7000 through 7145, inclusive, of the Business and Professions Code of the State of California. The successful Contractor will be required to furnish 2 acceptable surety bonds: one for Perform ance and the other for Payment. Each bond is to be executed in a sum equal to 100 percent of the contract price. City staff will verify that the certificate of authority of the insurer has not been surrendered, revoked, canceled, annulled, or suspended. In the event that the certificate of authority has been surrendered, revoked, canceled, annulled, or suspended, a renewed certificate of authority shall be submitted within 10 calendar days of the insurer’s receipt of the renewed certificate. No pre-bid meeting will be held for this project. Email all questions to Retroreflective_Backplates_LED_RRFB_Bid_Questions@docs.e-builder.net by 4:00 p.m., no later than 7 business days prior to the bid opening. The successful Contractor will be required to obtain a business license from the City of Modesto and pay related fees and taxes. The successful bidder must possess a valid Class “A” California Contractor’s License at the time of the award of this contract, to complete the Work as described. Each bid shall be made out on the Bid Form available through the OpenGov Procurement Portal and shall be accompanied by a bid security for not less than 10 percent of the amount of the bid. Each bid shall also be accompanied by an executed Local Hire Certification and Skilled and Trained Workforce Certification in accordance with Articles 7 and 8 of Chapter 3 of the Modesto Municipal Code. The City Clerk of the City of Modesto, California, will accept bids electronically through the OpenGov Procurement Portal until 11:00 a.m. on Tuesday, January 27, 2026, in accordance with the Contract Documents for the RETROREFLECTIVE BACKPLATES, LED STOP SIGNS INSTALLATION, RECTANGULAR RAPID FLASHING BEACONS (RRFB) project. Bid security may be provided in any of the following forms: (a) an electronic bid bond via Surety2000 at https://surety2000.com, (b) a certified check made payable to the City Clerk, (c) a cashier’s check made payable to the City Clerk, (d) cash, (e) an original, notarized hard copy bid bond made payable to the City Clerk and executed by the bidder as principal and surety as obligor, using the Bid Bond form included within the Bid Form (BF) pages and delivered in advance of the bid opening date. If bidder wishes to provide an electronic bid bond, bidder can register for a Surety2000 account at https://dashboard.surety2000.com/ register. Additional information is included in the appendix titled “Contractor Guide to Submitting Construction Bids in OpenGov.” If using a certified check, cashier’s check, cash, or hard copy bid bond, bidders are advised to notify the City Clerk’s office prior to the bid opening date. The certified check, cashier’s check, cash, or notarized bidder’s bond shall be enclosed in a sealed envelope and filed with the City Clerk, Tenth Street Place, 1010 Tenth Street, Suite 6600, Modesto, CA 95354, (Mailing Address: P.O. Box 642, Modesto, CA 95353) prior to the bid opening date and time listed above, with the outside of the bid envelope indicating: 1. NAME AND ADDRESS OF BIDDER. 2. City of Modesto assumes no responsibility for delay in delivery of the bid by the carrier your company chooses for delivery service or after it is delivered to the City’s central mailroom. It is solely the bidder’s responsibility to ensure the bid has been delivered to the proper location by the time specified. The above-mentioned bid security shall be given as a guaranty that the bidder will enter into the contract if awarded to him and will be declared forfeited if the successful bidder refuses to enter into said contract after being notified to do so by the City of Modesto. The City reserves the right to reject any or all bids or to waive any informalities or minor irregularities in a bid. No bidder may withdraw his bid for a period of 90 days after the date set for the opening thereof. Bidders shall review the City’s insurance coverage requirements with its insurance agent and verify that Bidder’s insurance coverage meets or exceeds the City’s requirements as stated in the Contract Documents. Bidders are notified that in case of either default in signing and returning the 2 copies of the contract and “Subcontracting Request” Form within 5 business days after having received Notice of Intent to Award the contract, or in case of default in obtaining and delivering fully executed and valid bonds and insurance acceptable to the City within 5 business days after having received Notice of Award, the proceeds of the check or bond accompanying this bid shall become the property of the City of Modesto.
