NOTICE OF PUBLICATION TO WHOM IT MAY CONCERN A bill to be entitled An act for the relief of Elijah Brinson; providing an appropriation to compensate him for injuries and damages sustained as a result of the negligence of the Public Health Trust of Miami-Dade County, Florida, d/b/a Jackson Memorial Hospital; providing a limitation on the payment of fees and costs; providing an effective date. Be It Enacted by the Legislature of the State of Florida: This act is intended to authorize and direct the Public Health Trust of Miami-Dade County, Florida, to pay, subject to any amounts already paid under s. 768.28, Florida Statutes, the remaining unpaid portion of the April 13, 2023, Final Judgment in Case No. 2019-029346-CA-01, together with any post judgment interest as allowed by law, as full and final compensation for the claims of Elijah Brinson against the Public Health Trust of Miami-Dade County, Florida, d/b/a Jackson Memorial Hospital, arising out of the facts described in this act. The Public Health Trust of Miami-Dade County, Florida, d/b/a Jackson Memorial Hospital, is authorized and directed to appropriate from funds not otherwise encumbered and to draw a warrant in favor of Elijah Brinson in the amount of $690,000, less any amounts previously paid pursuant to s. 768.28, Florida Statutes, plus applicable post judgment interest accruing from April 13, 2023, as provided by law, in accordance with the Final Judgment entered in Case No. 2019-029346-CA-01. The amount paid pursuant to this act is intended to be in addition to, and not in lieu of, any amounts payable by the Public Health Trust of Miami-Dade County, Florida, under the limits of liability in s. 768.28(5), Florida Statutes. Any amounts previously paid to or on behalf of Elijah Brinson by the Public Health Trust of Miami-Dade County, Florida, under s. 768.28, Florida Statutes, shall be credited against the total amount of the Final Judgment, and the amount paid under this act shall represent the unpaid portion of that judgment, plus interest as authorized in this act. Payment made pursuant to this act shall be full and final satisfaction of any and all present and future claims and causes of action that Elijah Brinson, his heirs, personal representatives, or assigns may have against the Public Health Trust of Miami-Dade County, Florida, d/b/a Jackson Memorial Hospital, arising out of the incident and facts described in this act. Any amount awarded under this act which is paid for attorney fees, lobbying fees, costs, or other similar expenses relating to this claim may not exceed 25 percent of the amount awarded under this act. Amounts paid for attorney fees, lobbying fees, costs, and other similar expenses relating to this claim may not exceed the percentage limitations of compensation for attorneys or claim bills as provided in s. 768.28, Florida Statutes. Attorney fees, lobbying fees, costs, and other similar expenses relating to this claim may not be based on the total amount of the judgment but shall be calculated based only on the amount awarded under this act.
