Pursuant to s. 727.111(4), Florida Statutes, the assignee may sell the assets of the estate other than in the ordinary course of business, and the Court may consider these actions without further notice or hearing unless a party in interest files an objection within 21 days from the date this paper is served. The Court has already held hearings and entered the Interim Order (A) Approving Assignee-In-Possession Financing, (B) Authorizing and Approving Sale Procedures, and (C) Scheduling Auction and Final Sale Hearing setting forth the Sale Procedures for the proposed sale of the assets.
If you object to the relief requested in this paper, you must file your objection with the Miami Dade Clerk of the Court at 20 NW 1st Avenue, Miami, Florida 33128 or electronically at https://www.myflcourtaccess.com/, with copies to be served upon the Assignee, Marc Barmat, 2255 Glades Rd Ste 419A, Boca Raton, FL 33431-7379, with copy to: (i) the Assignee's counsel Jason Rigoli, Esq., jrigoli@furrcohen.com, (ii) counsel to SouthStar, Brad Shraiberg at bss@slp.law and (iii) counsel to Purchaser, Eyal Berger, Esq., Akerman LLP, at eyal.berger@akerman.com..
If you file and serve an objection within the time permitted, the Court shall consider it at the hearing scheduled for April 8, 2026 at 4:00 p.m. (eastern) via Zoom videoconference. If you do not file an objection within the time permitted, the Assignee and the Court will presume that you do not oppose the granting of the relief requested in the paper.
