MIAMI-DADE COUNTY DEPARTMENT OF REGULATORY AND ECONOMIC RESOURCES DIVISION OF ENVIRONMENTAL RESOURCES MANAGEMENT NOTICE OF PROPOSED AGENCY ACTION Miami-Dade County ("MDC") Department of Regulatory and Economic Resources, Division of Environmental Resources Management ("DERM") gives notice that it intends to enter into a restrictive covenant with the owners of a contaminated site. Princeton Landings, LLC (Owner) is seeking this restrictive covenant in reference to Florida Department of Environmental Protection ("FDEP") Brownfield Site Identification No. BF139912011 and DERM Case # HWR-01260, SW 127 Ave & SW 240th Street, Princeton, Miami-Dade County, Florida (the Property), and intends to restrict exposure to arsenic and chromium contamination in the following manner: 1) access to groundwater shall be permanently restricted at the Property, and 2) engineering controls consisting of either two-feet of clean and uncontaminated soil or an impermeable cap shall be placed and maintained on the Property, that will be set forth in a Declaration of Restrictive Covenant between the Owner and MDC, that will further encumber the Property and be recorded in the public records of Miami-Dade County. Complete copies of the draft restrictive covenant and the DERM's preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays, at DERM, 701 NW 1st Ct., 4th Floor, Miami, FL 33136, as well as Miami-Dade County Public Records under case number HWR-01260 at http://ecmrer.miamidade.gov. Local governments with jurisdiction over the property subject to the Institutional and Engineering Controls, real property owner(s) of any property subject to the Institutional and Engineering Controls, residents of any property subject to the Institutional and Engineering Controls, and any party holding a materially affected encumbrance in the area subject to the control have 30 days from publication of this notice to provide comments to DERM.
