Notice of Intent to Request Release of Funds And Notice and Public Explanation of a Proposed Activity in the 100 – Year Floodplain February 27, 2026 City of Miami Department of Housing & Community Development 444 SW 2 Ave., 3rd Floor Miami, Florida 33130 The following notice satisfies two separate but related procedural requirements of the U.S. Department of Housing and Urban Development for activities to be undertaken by the City of Miami, Florida. Request for Release of Funds On or about March 16, 2026, the City of Miami will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) Program funds under Title I of the Housing and Community Development Act (HCDC) of 1974, as amended, for the Citywide Commercial Facade and Code Compliance Program project whose purpose is to rehabilitate the exterior façade/storefronts and correcting code violations of eligible for profit businesses located within the City of Miami. Improvements allowed under the façade program include pressure cleaning and painting; installing/replacing signs, installing/replacing awnings, installing/replacing shutters, installing/replacing windows, and installing/replacing doors and installing/replacing exterior light fixtures attached to the building. Under Code Compliance, the for-profit business will also be able to correct code violations and remove architectural barriers. This project is to be carried out by the City of Miami utilizing neighborhood community-based organizations that will solicit applications for participation from small businesses. The activity proposed, the Citywide Commercial Façade and Code Compliance Program, is Categorically Excluded (Subject to 58.5) under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Miami, Department of Housing & Community Development, 444 SW 2 Avenue, 3rd Floor, Miami, Florida 33130, and may be examined or copied weekdays between 8 A.M. to 5 P.M. An environmental review strategy has been prepared and as a result of this strategy it has been determined that the only applicable requirements of 24 CFR Part 58.5 and 58.6 for rehabilitation/minor repair of non-residential structures are Historic Preservation, Thermal/Explosive, Airport Clear Zones, Toxics and Air Quality will be treated consistent with Program requirements and Federal, State and local law. The reviews for these above-referenced factors will be carried out on a site-specific basis as each site is identified prior to the commitment of funds. Total estimated funding in the amount of $1,500,000 in Community Development Block Grant ("CDBG") funds will be allocated to this project over a five (5) year time frame as per the City of Miami's Consolidated Plan. The request for release of funds (RROF) will cover fiscal years FY2026 – 2031 (10/1/2026 through 9/30/2031). Notice and Public Explanation of a Proposed Activity in the 100 – Year Floodplain The City of Miami has conducted an evaluation as required by Executive Order 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 to determine the potential effect that its activity in the floodplain will have on the environment. The City of Miami has determined that it has no practicable alternative other than to approve the proposed project, described above. This activity will have no significant impact on the environment for the following reasons: 1. This project will address the high level of demand for the Citywide Commercial Façade and Code Compliance Program by small for-profit businesses located within the City of Miami. 2. The minor repair/rehabilitation of the commercial facades/storefronts of the small businesses will be in compliance with all floodplain protection measures as stipulated by the City and County as a part of their participation in the National Flood Insurance Program. 3. The proposed repairs will not displace or redirect flood waters in such a way that would seriously impact other areas. 4. All commercial structures, projects or developments assisted with federal funds must have flood insurance. Public Comments Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Miami Department of Housing & Community Development, located at 444 SW 2 Avenue 3rd Floor, Miami, Florida, 33130. All comments received by March 14, 2026, will be considered by the City of Miami prior to authorizing submission of a request for release of funds. Comments should specify which notice they are addressing. Release of Funds The City of Miami certifies to HUD that Mr. James Reyes, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Miami, Florida to use Program funds. Objections to Release of Funds HUD will accept objections to its release of funds and the City of Miami's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Miami; (b) the City of Miami has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted to HUD in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to: Department of Housing and Urban Development 909 S.E.
