A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, [APPROVING/DENYING] A DEVELOPMENT AGREEMENT WITH ALTA DEVELOPMENT LLC (DEVELOPER), PACMISO 13 CORP AND GREC PINECREST, LLC (OWNERS) FOR A LARGE-SCALE DEVELOPMENT OFF-CAMPUS STUDENT APARTMENTS PROJECT KNOWN AS "SOMI WALK SOUTH MIAMI" ON THE 1.04-ACRE DEVELOPMENT SITE LOCATED AT 5959 SW 71 STREET AND 7090 SW 59 PLACE, PURSUANT TO SECTION 20-8.7 OF THE CITY OF SOUTH MIAMI LAND DEVELOPMENT CODE; PROVIDING FOR AUTHORIZATION, CORRECTIONS, IMPLEMENTATION, AND AN EFFECTIVE DATE. (DEVELOPER) AND ROBINS PLAZA, LLC (OWNER) FOR A LARGE-SCALE DEVELOPMENT MIXED-USE PROJECT KNOWN AS "AVALON SOUTH MIAMI II" ON THE 1.34 ACRE DEVELOPMENT SITE LOCATED AT APPROXIMATELY 7230 SW 59TH AVENUE, CONSISTING OF THE PROPERTIES BOUNDED BY SOUTH DIXIE HIGHWAY (US 1), SUNSET DRIVE (SW 72ND STREET), DORN AVENUE (SW 59TH AVENUE), AND SW 73RD STREET, PURSUANT TO SECTION 20-8.7 OF THE LAND DEVELOPMENT CODE AND SECTIONS 163.3220-163.3243, FLORIDA STATUTES; PROVIDING FOR AUTHORIZATION, CORRECTIONS, IMPLEMENTATION, AND AN EFFECTIVE DATE. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING SECTION 20-3.3 "PERMITTED USE SCHEDULE," OF THE LAND DEVELOPMENT CODE TO ALLOW CERTAIN MEDICAL AND HEALTH CARE RELATED USES IN THE GENERAL RETAIL (GR) ZONING DISTRICT; PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTATION; AND AN EFFECTIVE DATE. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING SECTIONS 20-2.3 "DEFINITIONS," 20-3.5 "DIMENSIONAL REQUIREMENTS," 20-3.6 "SUPPLEMENTAL REGULATIONS," AND 20-4.5.1 "TREE PROTECTION" TO REVISE REGULATIONS RELATING TO SINGLE-FAMILY DEVELOPMENT; PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTATION; AND AN EFFECTIVE DATE. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, APPROVING A FRANCHISE AND JOINT USE AGREEMENT WITH SOMERSET ACADEMY INC., KNOWN AS SOMERSET ELEMENTARY AND MIDDLE SCHOOLS, FOR THE CONTINUED USE OF CERTAIN OUTDOOR FACILITIES AT MURRAY PARK DURING THE REGULAR SCHOOL YEAR AND INDOOR BASKETBALL GYMNASIUM AT THE GIBSON-BETHEL COMMUNITY CENTER FOR END OF THE SCHOOL YEAR AWARDS CEREMONY; AUTHORIZING THE CITY MANAGER TO FINALIZE AND EXECUTE THE JOINT USE AGREEMENT; PROVIDING FOR IMPLEMENTATION, CORRECTIONS, SEVERABILITY AND AN EFFECTIVE DATE. Stat., the City hereby advises the public that if a person decides to appeal any decision made by the Commission with respect to this matter, such person must ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This notice does not constitute consent by the City for the introduction or admission of otherwise inadmissible or irrelevant evidence, nor does it authorize challenges or appeals not otherwise allowed by law.
