NOTICE OF PUBLIC HEARING
A public hearing will be held by the City Commission of the City of Miami, Florida on Thursday, December 11, 2025, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, 33133 for the purpose of granting the following:
A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
BY A FOUR-FIFTHS AFFIRMATIVE VOTE WAIVING COMPETITIVE BIDDING,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE
CONSTRUCTION EASEMENT AGREEMENT IN FAVOR OF MIAMI FREEDOM PARK, LLC ("MFP") DATED FEBRUARY 9, 2023 ("CONSTRUCTION
EASEMENT"), PROVIDING FOR A REVISION OF THE CONSTRUCTION
EASEMENT AREA WITHIN A PORTION OF CITY OF MIAMI ("CITY") OWNED PROPERTY LOCATED AT 1550 NORTHWEST 37 AVENUE, MIAMI, FLORIDA, TO THE AREA MORE PARTICULARLY DESCRIBED IN THE SURVEY ATTACHED AND INCORPORATED AS EXHIBIT A ("CONSTRUCTION EASEMENT AREA"), AND AN EXPANSION OF THE PURPOSES OF THE EASEMENT TO INCLUDE A TEMPORARY ACCESS EASEMENT FOR THE CONSTRUCTION AND USE OF A TEMPORARY ROADWAY FOR PEDESTRIAN AND VEHICULAR INGRESS AND EGRESS WITHIN A PORTION OF THE CONSTRUCTION EASEMENT AREA MORE PARTICULARLY DESCRIBED IN THE SURVEY ATTACHED AND
INCORPORATED AS EXHIBIT B ("TEMPORARY ACCESS EASEMENT AREA"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
THE INGRESS, EGRESS, AND UTILITY EASEMENTS IN FAVOR OF MFP
DATED FEBRUARY 9, 2023 ("ACCESS EASEMENTS") , PROVIDING FOR
MODIFICATIONS TO THE ACCESS EASEMENT AREAS TO ACCOMMODATE VEHICULAR TRAFFIC TO AND FROM THE CITY'S ADMINISTRATION BUILDING AND TO INCLUDE AN ADDITIONAL PERMANENT ACCESS EASEMENT FOR
PEDESTRIAN AND VEHICULAR INGRESS AND EGRESS WITHIN THE AREA MORE PARTICULARLY DESCRIBED IN THE SURVEY ATTACHED AND
INCORPORATED AS EXHIBIT B; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID EASEMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO
EFFECTUATE THIS TRANSACTION.
Said proposed resolution(s) may be inspected by the public at the Office of the City Clerk, 3500 Pan American Drive, Miami, Florida 33133, Monday through Friday, excluding holidays, between the hours of 8 a.m. and 5 p.m., or
http://miamifl.iqm2.com five days before the date of the Commission Meeting.
All interested persons are invited to appear at the meeting and may be heard with respect to the proposed resolution. Should any person desire to appeal any decision of the City Commission with respect to any matter to be
considered at this meeting, that person shall ensure that a verbatim record
of the proceedings is made including all testimony and evidence upon which
any appeal may be based (F.S. 286.0105).
Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City
Commission meeting is cancelled or is not held due to a lack of a quorum or other emergency, a special City Commission meeting will be automatically scheduled for the Tuesday immediately following the cancelled meeting. In the event of one of the aforementioned circumstances, the special meeting would be held on December 16, 2025, at 9:00 a.m. in the City Commission chambers located at Miami City Hall, 3500 Pan American Drive, Miami, Florida 33133. All of the scheduled agenda items from that cancelled meeting shall automatically be scheduled as an agenda item at the special City Commission meeting.
The City Clerk shall notify the public of the special meeting that is to take place by placing a notice of the special City Commission meeting at the entrance
of City Hall and the City's main administrative building, placing a notice on
the City's website, and, if feasible, placing an ad in a newspaper of general
circulation before the special meeting on the immediately following Tuesday. There shall be no additional notice by publication required for any such
scheduled agenda item that is moved to the special City Commission meeting.
