NOTICE AND SUMMARY OF ORDINANCE NO. CS 1084 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ATWATER ADDING CHAPTER 10.53 (E-BICYCLES) TO TITLE 10 OF THE ATWATER MUNICIPAL CODE RELATING TO THE SAFE OPERATION OF ELECTRIC BICYCLES AND OTHER ELECTRIC CONVEYANCES Notice is hereby given that on October 12, 2026 the City Council of the City of Atwater adopted Ordinance No. CS 1084, adding Chapter 10.53 to Title 10 of the Atwater Municipal Code to regulate the safe operation of electric bicycles (e-bikes) and other electric conveyances. The ordinance establishes safety requirements for the operation of e-bikes, electric scooters, electric boards, and similar vehicles on public property within the City of Atwater. Regulations include speed limits for sidewalks, school zones, and designated trails; compliance with traffic control devices; restrictions on unsafe riding practices; helmet requirements for minors and other riders as required by state law; and limitations on the operation of electric conveyances in parks and recreational areas. The ordinance also prohibits unauthorized modifications to e-bikes that alter their speed capabilities or classifications and establishes parental responsibility for violations committed by minors. Violations may result in warnings, administrative citations, fines, or other lawful enforcement measures. Administrative fines are established at $100 for a first violation, $200 for a second violation within 12 months, and $500 for third and subsequent violations within 12 months. Eligible minors may be permitted to participate in a bicycle or traffic safety education program in lieu of a first administrative fine. The ordinance also authorizes the impoundment of electric conveyances under specified circumstances.
