A distance of 1975.49 feet; thence leaving said centerline and north line, s. 00° 13’ 00” W. a distance of 1315.17 feet; thence s. 89° 54’ 30” E. A distance of 1544.97 feet; thence s. 00° 13’ 00” W. A distance of 1973.53 feet; thence n. 89° 54’ 30” W. A distance of 3520.44 feet to a point on the west line of said section 33; thence along the said west line, N. 00° 13’ 00” E. Beneficiary hereby elects to conduct a unified foreclosure sale pursuant to the provisions of California Commercial Code section 9604, et seq., and to include in the non-judicial foreclosure of the real property interest described in the Notice of Default and Election to Sell Under Deed of Trust, all of the personal property and fixtures, together with replacements and proceeds, if applicable, described in the security agreement, dated 4/24/2020, and in a UCC-1 Financing Statement filed with the Secretary of State, State of California, on 9/20/2017, as 177607043974, it may have been amended from time to time, and pursuant to any other instruments between the trustor and beneficiary referencing a security interest in personal property. Beneficiary reserves its right to revoke its election as to some or all of said personal property and/or fixtures, or to add additional personal property and/or fixtures to the election herein expressed, at Beneficiary’s sole election, from time to time and at any time until the consummation of the Trustee’s Sale to be conducted pursuant to the Deed of Trust and this Notice of Trustee’s Sale. A description of the personal property, which was given as security for trustor’s obligation is: “Land” Shall mean that certain real property in the above-described legal description. “Borrower” shall mean Josh Anthony Ringeisen aka Joshua A. Ringeisen and Lori Ringeisen aka Lori A. Ringeisen Personal Property Collateral includes all attachments, accessions, replacements or additions to the following, and all proceeds or products of the following, but specifically excludes consumer goods and hemp or any product of hemp, as the term hemp is defined in 7 U.S.C. § 1639o(1): All goods of the following kind and description wherever located (whether characterized as fixtures or personal property) now constructed, located, or placed on the Land, or used in connection with the Land: (i) enclosures of the Land or any part thereof, including, without limitation, fences, corrals, pens, gates, shunts, posts, poles, barbed wire and electric wire; (ii) trees, vines and other permanent plantings, whether mature or immature, now growing on the Land, together with all trellises, wires, end posts, cross arms, supports and stakes relating thereto; (iii) irrigation wells, pumps, motors and related equipment, and irrigation and drainage equipment, including, without limitation, wells, pumps, motors, engines, gearheads, sprinklers, drip irrigation systems, tow lines, hand lines, irrigation pipe, drainage pipe, culverts and well casings; (iv) crop protection equipment and apparatus, including, without limitation, frost protection equipment and wind machines; and (v) electric, gas and water lines and equipment, including without limitation, transformers, circuit breakers, switch boxes, fuse and breaker panels, regulators, cut on/off valves, wiring and pipe. (a) All rights associated with or arising with respect to the Land as the result of the implementation of the Sustainable Groundwater Management Act (California Water Code Sections 10720, et seq.) (“SGMA”), as it may be amended, including without limitation groundwater pumping credits, pumping allocations, and extraction rights of any kind, whether or not severable from the Land, regardless of when or where such rights may be exercised (collectively, “SGMA Rights”). (b) All reports and records submitted to any applicable groundwater sustainability agency(“GSA”) or other public agency having jurisdiction over the applicable groundwater basin associated with the Land, and all historical records regarding groundwater pumping, utility usage, pump tests, and other information reasonably necessary to establish groundwater extraction history for the Land. (c) All right, title and interest in all water (including any water inventory in storage), water rights and entitlements, other rights to water and other rights to receive water or water rights of every kind or nature, including without limitation: (i) SGMA Rights; (ii) the groundwater on, under, pumped from or otherwise available to the Land, whether as a result of groundwater rights, contractual rights or otherwise; (iii) the right to remove and extract any such groundwater including any permits, rights or licenses granted by any governmental authority or agency, including rights under groundwater sustainability or management plans and related judicial or administrative decisions, and any rights granted or created by any easement, covenant, agreement or contract with any person or entity; (iv) any rights to which the land is entitled with respect to surface water, whether such right is appropriative, riparian, prescriptive or otherwise and whether or not pursuant to permit or other governmental authorization, or the right to store any such water; (v) any water, water right, water allocation, distribution right, delivery right, water storage right, or other water-related entitlement appurtenant or otherwise applicable to the Land by virtue of the Land’s being situated within the boundaries of any district, agency, or other governmental entity or within the boundaries of any private water company, mutual water company, or other non-governmental entity; (vi) any drainage rights appurtenant or otherwise applicable to the Land; (vii) all rights to transport, carry, allocate or otherwise deliver water or any of the foregoing rights from or to the Land by any means, wherever located; and (viii) any shares (or any rights under such shares) of any private water company, mutual water company, or other non-governmental entity pursuant to which Borrower or the Land may receive any of the rights referred to in (i) through (vii), above. References to “water’’ and “water rights” are used herein in the broadest and most comprehensive sense of the term(s). No warranty is made that any or all of the personal property still exists or is available for the successful bidder and no warranty is made as to the condition of any of the personal property, which shall be sold “as is, where is”. You have the right to request an accounting of the unpaid indebtedness secured by the property being sold. You may submit your request to the address listed below. The beneficiary under said Deed of Trust and Security Agreement heretofore executed and delivered to the undersigned, a written Declaration of Default and Demand for Sale, and a Written Notice of Default and Election to Sell. The undersigned caused said Notice of Default and Election to Sell to be recorded in the County where the real property is located and more than three months have elapsed since such recordation. In the event that the Deed of Trust described in this Notice of Trustee’s Sale is secured by real property containing one to four single-family residences, the following notices are provided pursuant to the provisions of Civil Code section 2924f. Notice to potential bidders: If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property.
