PUBLIC NOTICE NOTICE BY THE CITY OF LIVINGSTON CITY COUNCIL OF ITS ADOPTION OF ORDINANCE NOTICE IS HEREBY GIVEN that on April 21, 2026, at 7:00 p.m., or as soon after the City Council of the City of Livingston adopted an Ordinance, entitled: AN ORDINANCE OF THE CITY OF LIVINGSTON AMENDING CHAPTER 2-4 OF TITLE 3 OF THE LIVINGSTON MUNICIPAL CODE REGULATING SIDEWALK VENDING This proposed Ordinance relates specifically to Non-Motorized Vendors (also known as Compact Mobile Food Operations), defined under the Cal. Retail Food Code as "a food facility that operates from an individual or from a pushcart, stand, display, pedal-driven cart, showcase, rack, or otherwise nonmotorized conveyance." This ordinance does not apply to Food Trucks or other similar motorized forms of food vendors. The itinerant vendor ordinance is being amended to update the title, definitions, permit application process, and operational standards to ensure statutory compliance while preserving local public-safety controls. Compliance with State Law. The amendment generally realigns and reorganizes current regulations to apply specifically to sidewalk vendors. This was done by revising the definitions to mirror statutory language in the Government Code and Health and Safety Code. The amendment also revises the permit application process to eliminate background checks, fingerprinting, and inquiring into an individual's criminal history. Updated Permitting and Appeal Process. The amendment clearly outlines the necessary vendor permits and licenses under local and county requirements. It also streamlines the appeal process to be more efficient. Time, Place, and Manner Restrictions. The amendment includes updated time, place, manner restrictions such as prohibiting vending within certain distances of farmers' markets or special events. This action is exempt from the California Environmental Quality Act ("CEQA") because it does not qualify as a "project" pursuant to Public Resource Code Section 21065 and CEQA Guidelines Sections 15320, 15378 and 15061(b)(3) because it can be seen with certainty that there is no possibility the City's action would cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The proposed ordinance shall become effective on May 22, 2026.
