NOTICE IS HEREBY GIVEN that the Planning Commission will hold a public hearing on the following item on the date and time listed:
Zoning Ordinance Text Amendment 2025-01. An Ordinance of the City Council of the City of Livingston amending Livingston Municipal Code Title 5, Chapter 2, Section 5-2-2 "Residential", Chapter 2, Section 5-2-3: "Commercial", Chapter 3, Section 5-3-15: "Land Use Regulations (Zoning Matrix)", Chapter 3, Section 5-3-16: "Lot Development Standards", Chapter 4, Section 5-4-5: "Off-Street Parking and Loading", Chapter 5: "Specific Use Regulations", Chapter 5, Section 5-5-1: "Density Bonuses", Chapter 6: "Administration", Chapter 6, Section 5-6-1: "Powers and Duties", Chapter 6, Section 5-6-7: "Site Plan and Design Review", Chapter 6, Section 5-6-9: "Use Permit, Temporary and Conditional", and Chapter 7, Section 5-7-2: "Definitions of Words and Phrases" related to housing development and standards, including definitions, off-street parking, Site Plan and Design Review, density bonuses, Use Permits, ministerial approvals, emergency shelters, single room occupancy, and residential and commercial uses zoning matrix.
The Ordinance Amendment is an update to various Chapters and Sections of the Livingston Municipal Code to update housing development standards. The proposed Ordinance will: 1) add definitions for the terms Supportive Housing and Single Room Occupancy and revise the definition for Farm Labor Housing; 2) add a definition for the term Low Barrier Navigation Centers and revise the definitions for Emergency Shelters and Licensed Community Care Facility; 3) add Transitional Housing and Supportive Housing as permitted uses in all zoning districts, add Single Room Occupancy as a permitted use in R-2, R-3, DTC, C-2, and C-3 Zoning Districts, and add Low Barrier Navigation Centers as a permitted use in C-1 and DTC Zoning Districts; 4) amend the Multiple-Family Apartment Dwellings use to be permitted in R-2 and C-1 Zoning Districts, amend the Emergency Shelter use to be permitted in R-1, R-2, R-3, and C-1 Zoning Districts, and amend the Licensed Community Care Facility use to be permitted in the R-2, C-1, and DTC Zoning Districts; 5) update the maximum site coverage for the R-3 Zoning District; 6) add parking standards for senior housing, single room occupancy, supportive housing, and emergency shelters and reduce the parking standards for Mobilehomes; 7) add development standards for emergency shelters and single room occupancy units; 8) update the Density Bonus Ordinance to be consistent with State Law; 9) establish procedures for ministerial and by-right approvals; 10) clarify the powers of planning commission in regard to the Site Plan and Design Review process; 11) add objective design standards for the Site Plan and Design Review process; 12) add objective standards for Use Permits; 13) and add definitions for Affordable Housing Cost, Affordable Rent, Area Medium Income, Bridge Housing, Community Crisis Home, Concession or incentive, Enhanced Behavioral Home, Foster Family Home, Small Family Home, Group Home, Housing First, Infill Site, Low income households, Moderate income households, Private Alternative Boarding School, Private Alternative Outdoor Program, Recuperative Care, Residential Care Facilities, Respite Care, Senior Housing, Short-Term Residential Therapeutic Program, Streamlined Ministerial Approval, Transitional Shelter Care Facility, Transitional youth, and Very low income households.
The proposed Ordinance is exempt from analysis under the California Environmental Quality Act (CEQA) under the "Common Sense Exemption" that CEQA applies only to projects that have the potential for causing significant environmental effects, as specified in Section 15061(b)(3) of the CEQA Guidelines.
The Planning Commission will be considering and providing a recommendation to the City Council on the above Ordinance.
