NOTICE OF SALE UNDER POWER STATE OF GEORGIA BIBB COUNTY By virtue of a power of sale contained in a certain security deed from Lemonte Bentley to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for New Day Financial, LLC, its successors and assigns and recorded in Deed Book 11899, Page 135-162, Bibb County, Georgia records given to secure a note in the original amount of $320,999.00 with interest on the unpaid balance until paid, the following described property will be sold at public outcry to the highest bidder for cash at the courthouse door of BIBB COUNTY, Georgia, or at such place as has or may be lawfully designated as an alternative location within the legal hours of sale on the first Tuesday in March, 2026, to wit: March 03, 2026, the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 234 OF THE 3RD LAND DISTRICT OF BIBB COUNTY, GEORGIA, BEING DESIGNATED AS LOT 86, CONTAINING 0.66 ACRE, MORE OR LESS, TOBEE CREEK SUBDIVISION - PHASE III, ACCORDING TO A SUBDIVISION SURVEY ENTITLED "FINAL PLAT OF TOBEE CREEK SUBDIVISION PHASE III", PREPARED BY WELLSTON ASSOCIATES LAND SURVEYORS, LLC, DATED NOVEMBER 24, 2009, AND RECORDED IN PLAT BOOK 93, PAGES 261-262, CLERK'S OFFICE, BIBB SUPERIOR COURT, WHICH PLAT BY THIS REFERENCE THERETO IS INCORPORATED HEREIN FOR A MORE PARTICULAR AND ACCURATE DESCRIPTION OF SAID PROPERTY. SAID PARCEL HAS THE METES, BOUNDS AND DIMENSIONS AS SHOWN ON SAID PLAT. THERE IS A DWELLING LOCATED THEREON KNOWN UNDER THE PRESENT SYSTEM OF NUMBERING AS 343 WILLOW COVE, LIZELLA, GEORGIA 31052. BEING THE SAME PROPERTY AS CONVEYED TO LEMONTE BENTLEY FROM THREE OAKS CONSTRUCTION AND DEVELOPMENT, INC, A GEORGIA CORPORATION BY THAT DEED DATED 09/29/2023 AND RECORDED 10/03/2023 IN BOOK / PAGE : 11696 / 94 IN THE BIBB COUNTY RECORDS. Being real property commonly known as 343 Willow Cove Court, Lizella, GA 31052. The debt secured by the above-referenced security deed has been declared due because of the default in the payment of said debt per the terms of the note and other possible defaults by the borrower or the successor thereto. The debt remaining in default, this sale will be made for the purpose of paying the debt and all expenses of this sale including attorney's fees (notice of intent to collect attorney's fees having been given). Said sale will be made subject to the following items which may affect the title to said property: All restrictive covenants, easements and rights-of-way appearing of record, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding or unpaid bills and assessments for street improvements, curbing, garbage, water, sewage and public utilities which may be liens upon said property; and any outstanding taxes, assessments and other liens superior to the security deed being foreclosed hereby. To the best knowledge and belief of the undersigned, the above-described property is in the possession of the borrower and/or other persons with the consent and acquiescence of the borrower.
