NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF BIBB By virtue of a Power of Sale contained in that certain Security Deed from Betty P. Howells and Stanley D. Howells to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. ACTING SOLELY AS NOMINEE FOR SUNTRUST MORTGAGE, INC., dated April 6, 2012 and recorded on April 12, 2012 in Deed Book 8711, Page 338, in the Office of the Clerk of Superior Court of Bibb County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of One Hundred Thirty-Six Thousand and 00/100 dollars ($136,000.00) with interest thereon as provided therein, as last transferred to NewRez LLC dba Shellpoint Mortgage Servicing, recorded in Deed Book 12154, Page 252, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Bibb County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in March, 2026, all property described in said Security Deed including but not limited to the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN BIBB COUNTY, GEORGIA, IN LAND LOT 265 OF THE 13TH LAND DISTRICT BEING KNOWN AND DISTINGUISHED AS LOT NO. 4 IN A SUBDIVISION OF THE PROPERTY OF THE ESTATE OF A.C. YEOMANS, SR., ACCORDING TO A PLAT THEREOF MADE BY JAMES A. GORDON, JR., GEORGIA REGISTERED LAND SURVEYOR, SAID PLAT BEING DATED FEBRUARY 15, 1972, SAID PLAT BEING RECORDED IN PLAT BOOK 49, PAGE 99, BIBB COUNTY CLERK'S OFFICE, GEORGIA. SAID PLAT BY THIS REFERENCE THERETO IS INCORPORATED HEREIN FOR A MORE ACCURATE LEGAL DESCRIPTION. ALSO: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING, AND BEING IN LAND LOT 265 OF THE13TH LAND DISTRICT, BIBB COUNTY, GEORGIA AND BEING PART OF LOT 3 OF PROPERTY BELONGING TO THE ESTATE OF A.C. YOUMANS, SR., AS SHOWN ON A PLAT RECORDED IN PLAT BOOK 49, FOLIO 99, SAID CLERK'S OFFICE. SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT AN IRON PIN LOCATED AT THE SOUTHWEST CORNER OF SAID LOT 3 ON THE NORTHERN RIGHT OF WAY LINE OF YEOMANS DRIVE AT THE DIVIDING LINE OF LOTS 3 AND 4; THENCE SOUTH 88°51'30" EAST ALONG THE RIGHT OF WAY LINE OF YEOMANS DRIVE A DISTANCE OF 5 FEET TO AN IRON PIN; THENCE CONTINUING ALONG THE RIGHT OF WAY LINE OF YEOMANS DRIVE SOUTH 87°20'30" EAST A DISTANCE OF 188.2 FEET TO AN IRON PIN; THENCE NORTH 11°18' EAST ALONG THE DIVIDING LINE OF LOT 3 FROM THE F.B. DUGGER PROPERTY A DISTANCE OF 247.7 FEET TO A POINT; THENCE FROM SAID POINT IN A WESTERLY DIRECTION A DISTANCE OF 235 FEET; MORE OR LESS, TO AN IRON PIN LOCATED AT THE NORTHEAST CORNER OF LOT 4 AS SHOWN ON THE ABOVE MENTIONED PLAT; THENCE SOUTH 1°08'30"" WEST A DISTANCE OF 236.4 FEET TO THE POINT OF BEGINNING. Said property may more commonly be known as 1001 Bass Rd, Macon, GA 31210. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given). The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is NewRez LLC dba Shellpoint Mortgage Servicing, 75 Beattie Place, Greenville, SC 29601, 1-800-365-7107. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are Betty P. Howells, Stanley D. Howells and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code and 2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
