NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained with that certain Security Deed dated June 30, 2003, from Bertha L. White to ABN Amro Mortgage Group, Inc., a Delaware Corporation, recorded on July 3, 2003 in Deed Book 5830 at Page 205 Bibb County, Georgia records, having been last sold, assigned, transferred and conveyed to Wilmington Savings Fund Society, FSB, as trustee of Stanwich Mortgage Loan Trust F by Assignment and said Security Deed having been given to secure a note dated June 30, 2003, in the amount of $62,026.00 said note being modified by Loan Modification agreement and recorded on June 17, 2025 in OR Book 12179 OR Page 187 in the real property records of Bibb County, Georgia, and said Note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Bibb County, Georgia, on February 3, 2026 the following described real property (hereinafter referred to as the "Property"):
ALL THAT CERTAIN PROPERTY SITUATED AND BEING IN THE 4TH DISTRICT OF BIBB COUNTY, GEORGIA AND BEING LOTS 10 AND 11 OF BLOCK OF BLOOMFIELD ESTATES AS SHOWN ON A PLAT MADE BY E.L. GOSTIN, C.E., DATED DECEMBER 15, 1951, AMENDED FEBRUARY 6, 1952 AND RECORDED IN PLAT BOOK 21, FOLIO 199, CLERK'S OFFICE BIBB SUPERIOR COURT, 1932 AND RECORDED IN PLAT BOOK 21, FOLIO 199, CLERK'S OFFICE BIBB SUPERIOR COURT, AND BEING MORE PARTICULARITY DESCRIBED AS FOLLOWS:
FROM THE SOUTHERN MOST INTERSECTION OF THE NORTHERLY SIDE OF EMERSON CIRCLE AND THE WESTERLY SIDE OF NISBET DRIVE, RUN IN A WESTERLY DIRECTION ALONG THE NORTHERLY SIDE OF EMERSON CIRCLE FOR A DISTANCE OF 425 FEET TO AN IRON PIPE, THE POINT OF BEGINNING: THENCE IN A NORTHERLY DIRECTION ALONG THE WESTERLY LINE LOT 9 OF SAID BLOCK A DISTANCE OF 122.5 FEET TO AN IRON PIPE WHICH MARKS THE COMMON CORNER OF LOTS 9, 10 AND 11 OF SAID BLOCK; THENCE IN A WESTERLY DIRECTION ALONG THE SOUTH LINE OF LOT 11 OF SAID BLOCK A DISTANCE OF 125 FEET TO AN IRON PIPE ON THE EASTERLY SIDE OF LOT 11 OF SAID BLOCK A DISTANCE OF 125 FEET TO AN IRON PIPE ON THE EASTERLY SIDE OF EMERSON CIRCLE; THENCE IN A SOUTHERLY DIRECTION ALONG THE EASTERLY LINE OF EMERSON CIRCLE A DISTANCE OF 47.5 FEET TO AN IRON PIPE; THENCE CURVING TO THE LET IN A CIRCLE A DISTANCE OF 47.5 FEET TO AN IRON PIPE; THENCE CURVING TO THE LEFT IN A SOUTHERLY AND EASTERLY DIRECTION ALONG THE ARC OF A CIRCLE WITH A RADIUS OF 75 FEET TO AN IRON PIPE, SAID ARC BEING SUBTENDED BY A CHORD OF 106 FEET; THENCE IN AN EASTERLY DIRECTION ALONG THE NORTHERLY LINE OF EMERSON CIRCLE A DISTANCE OF 50 FEET TO AN IRON PIPE, THE POINT OF BEGINNING.
SAID LOT 11 FRONTS 85 FEET ON THE EASTERLY SIDE OF EMERSON CIRCLE AND EXTENDS IN AN EASTERLY DIRECTION THEREFROM A DISTANCE OF 200 FEET ON ITS NORTHERLY SIDE AND 125 FEET ON ITS SOUTHERLY SIDE END EXTENDS ALONG LOT 9 OF SAID BLOCK IN THE REAR FOR A DISTANCE OF 113.3 FEET. SAID LOT IS BOUNDED ON THE WEST BY EMERSON CIRCLE, ON THE NORTH BY LOT 12 OF SAID BLOCK, ON THE SOUTHEAST BY LOT 9 OF SAID BLOCK AND ON THE SOUTH BY LOT 10 AS AFORESAID.
THE PROPERTY IS CONVEYED SUBJECT TO THE RESTRICTIVE COVENANTS APPEARING OF RECORD IN DEED BOOK 633, FOLIO 165, CLERK'S OFFICE BIBB SUPERIOR COURT, AND ALSO SUBJECT TO AN EASEMENT FOR ROAD DRAINAGE PURPOSES IN FAVOR OF BIBB COUNTY.
The debt secured by the Security Deed and evidenced by the Note has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Bertha L. White.
The property, being commonly known as 2949 Emerson Cir, Macon, GA, 31206 in Bibb County, will be sold as the property of Bertha L. White, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
Pursuant to O.C.G.A.§ 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above-described mortgage is as follows: Carrington Mortgage Services, 500 N. State College Blvd., Suite 1300, Orange, CA 92868, 800-561-4567. The foregoing notwithstanding, nothing in O.C.G.A. § 44-14-162.2 shall require the secured creditor to negotiate, amend or modify the terms of the mortgage instrument.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under U.S. Bankruptcy code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
